Default Help pls - First Plus PPI complaint

    Hi,

I've sent 2 letters to First Plus which they have responded to but totally ignored the points of my complaint.

They have referred the complaint to the broker Norton Finance who have only responded to my first letter.

My complaint referred to the amount of rebate when I redeemed two loans (the first loan was combined into another). The first loan was via Norton however the second loan was via First Plus. The first PPIicon rebate only meant a small loss to me however the second rebate was very small compared to the total amount of PPI.

In my second letter to First Plus I requested they resolve or I would take further action via the court and report to fosicon.

First Plus have simply referred me back to Norton !!

Please could I have some advice regarding my next steps.

The loans were taken out in 2002 so I'm unsure if I can complain to FOS and I may have to complain to the FLA (????).

Do I have to wait for my complaint to be completed before I can raise any action via the court?

Any help would be greatly appreciated

    Thanks

    Hello Mr Monkey

    Welcome to the forum.

I have to ask a few questions.

Who set up the original loans??????? Dependant on who set up the loans. This is your first post of call.

These companies will pass you from one to another in an attempt to frustrate matters somwhat.

The majority of ppi sales on loans were commission based, one would pay an incentative for the other to apply it. There is legislation regarding this in the ppi info stickies.

Both these companies have to take responsibility for this mis selling as they both profited from it.

The fact the loans were taken out in 2002, more than likely means that the fos will not investigate, but you can always ring or write to them for advice.

The other important point is that you have to exhaust their internal complaints procedure and get a final response letter from them to pursue them via the court if necessary. This shows that you have given them every opportunity to right the wrong before you have been forced to take action.

If you need any help please ask

If any of my posts are helpful, please feel free to click my scales. All information is given as my opinion only, based on my own personal experiences. I have no legal training, but have educated myself in aspects of consumer legislation. My motto "NEVER GIVE IN, NEVER SURRENDER", THERE IS A WAR ON YOU KNOW

Please could anyone clarify who I should be complaining to as I believe that I can't direct it to fosicon as the loans were taken out in 2002.

    Norton still haven't bothered replying

    Thanks

Your best bet is to ring the fosicon tomorrow and tell them all about it they should be able to advise you if they can help or who can.
If this about insurance rebate they may say the insurance company is responsible. Who is the insurance with?
Did you take out the loans in 2002 or get the rebate in 2002?

Both loans were taken out in 2002.

First loan was redeemed by a further advance and approx £730 was added to the new loan after the PPIicon rebate. We then redeemed the new loan in May 2003 and given a rebate of approx £1350 against a total premium of £9800 !!

First Plus wrote back to me blaming Norton Finance and have alledgedly asked them to contact me. A month later I have heard nothing from Norton Finance and no further contact from First Plus.

As I can't complain to fosicon I need to establish who I should complain to now ??

If you are complaining about the rebate in 2003, the FOS should be able to tell you who to complain to even if it is not them.
