    Default MBNA PPI - No recording of call

    THATS BECAUSE I DIDN'T APPLY OVER THE PHONE!!!!?????

    Started my claim by sending standard letter to MBNAicon on 29th Sept, they recieved it 2nd Oct, i did get an ackowledgement on 8th Oct telling me they would write to me with a final response by 28th. I got my final response today dated 14th Oct telling me I wasn't mis-sold as I agreed to it according to their notes in Nov 02 over the phone. However they dont keep copies of calls after 6 months so cannot provide me with a copy and the letter also states they do not require signed consent to agree to PPIicon as they send the T&C's anyway!

    A few things which concern me
    1) I NEVER apply for things by phone, my app was written!
    2) Why on earth do they not require a signatureicon??? How do they know I agree or understand the T&C's??
    3) Deleting calls after 6 months????
    4) How did they know on the 8th Oct that it would only take them till 28th to reach a final response????

    Considering this is their final response I will now go for fosicon, has anyone had any similar dealings with MBNA?????



    Argos storecard - Refund £677 just 1 week after standard letter sent -refunded to account though, wouldn't send me a cheque!
    Mbna - Ongoing........
    Barclaycard - Letter recieved by them 1st, had to chase but they are looking into it now and retrieving original app
    Eggicon - Same as above!
    Pinnacle - Ongoing......

    I can see by your ?????? that you seem displeased with their response and I can understand why. They must be morons

    mbna like to send final responses to their customers, cause It might make some of them not continue with their complaint, but we know better.

    Have your sent them a S.A.R - (Subject access requesticon) or a request under section 77/78 for a copy of your credit agreement?application form.

    If you have not do so, get some homework done, before you approach the fos.

    mbna will soon realise that they cannot fob their customers with the we don't keep recorded telephone callsicon after 6 months, serious breach of the data protection act springs to mind, they have to by law keep them for 6 yearsicon

    Hello HHNF - I'm seething!!! Like you say it is obviously just a get lost final response, or a "we dont realise you are a member of CAGicon" final response!
    S.A.R will be winging its way for a copy of the CCA which I very much doubt they will provide if they dont keep phone callsicon!

    cca from MBNAicon LOL HEHE!!!!!!!!!! yah right ive been trying for the last yr with no avail got nothing back for my S.A.R or CPR 18 now with the court.

    If you want a copy of your ca, you must send them a request under section 77/78 of the cca 1974. It costs £1 and they have 12+2days postage to comply.

    Here is the link to the template you need letter N

    Send everything recoreded delivery and keep a track on the royal mail website,

    If you just send a S.A.R - (Subject access requesticon) they may not provide the ca as they state it is not held in a relevaant filing system. Best to cover all bases:grin:

    this is the full Consumer Credit Act 1974 as HHNF has mentioned sections 77/78 should help.

    If they do reply using the excuse above, then check it out with the Information Commissioner's Office. If they are holding documents on microfiche.. it IS a relevant filing system
