I have lurked on here a week or so now and am impressed with the help and advice everyone is giving.
I am considering claiming my late charges etc from Barclaycard, and today when I looked at my last few statements online, noticed that previous months they showed "Payment Protection Plan" and last month show "Optional Payment Protection". I will be sending a S.A.R - (Subject access request) for all detials, but my question is, is this grounds for me to begin questioning their mis-selling?
I took out the card about 10 years or so ago and don't recall asking for it.
I also queried a while back FAP fees that were taken, cancelled them, but didn't challenge them. Should I chase repayment of these too?
Welcome to the PPI forum, we're veryhappy to help you with a claim fo mis-selling of PPI should you decide to pursue this.
I would first suggest that you look here PPI in order for you to decide if and how PPI has been mis-sold on your Barclaycard account. See also the In the Media section on the home page of this site and go to PPI in the media to keep up with organisations fined and the FSA and Competition Commission reports on customers' complaints and the volume of mis-selling.
You don't say how many statements you haev where you've noticed the PPI payments, but your SAR will certainly be revealing. It seems from what you say that PPI has been added to your card account without your knowledge or consent, which is against industry guidelines and regulations in selling such products.
I would suggest your SAR should include a request for: a true copy of the application form as signed by yourself, a true copy of the credit agreement, the terms and conditions of the account to include the PPI element and ALL statements for the account to date.
I anticipate that B/card will be difficult on the statement front as this goes back 10 years ... but they can certainly do it if they put their mind to it.
As to the charges, this is a separate matter. You can include a request for repayment of these in your whole claim against B/card.

I only recall seeing F.A.P (Family Accident Protection - I was single with no children at the time) deductions on previous statements but not PPI, maybe they lost out on one and started another, or I just ignored them as being compulsory! As you say the SAR will shed light on this.
None of these products are compulsory, whatever name they want to give them, they're still PPI and all have exclusion clauses which might mean that they were useless to you in the first place ...

Could someone please advise me on PPI with regards to my Amex thread , where I believe the CCA(?) provided is not enforceable. Would this also invalidate the PPI (box ticked)?
At the time of application I was a temp.
It was also a postal application, if that makes any difference too!

Well, I have received by SAR which only contains copy statements from 2002, no cca and no telephone transcripts.
The covering letter states that this information is all that they hold.
Will this make my mis-selling claims stronger, or could they be holding back?
I canceled the f.a.p. last year, surely they'd have transcripts of that conversation!!
Any appropriate letter templates would be greatly appreciated.

You said that the card was taken out about ten years ago, is 2002 about right or have they short changed you? It will also be difficult to get them to send you the CCA on an account that is no longer running (or is it?). If it is, then you are entitled to receive the agreement.
Did they send you the Terms & Conditions of the card including the PPI element?
With regards to the lack of telephone transcripts, this is not surprising as they may not have recorded the call at that date but they will still have to prove to you that the salesperson followed FSA guidelines in selling you the PPI to ensure that you had all the info available to help you make an informed choice about the product you purchased.
If you want to you could write to the person who has sent this info telling them that the info sent is incomplete and that they have X number of days in which to fulfil the S.A.R - (Subject access request).
I did warn you that Barclays are toughies and you need to be very firm with them and respond quickly in writing to get what you want.

I just popped over to your Amex thread and noticed that 42Man has helped you with this. He is a star helper in my opinion and I used a couple of previous letters of his together with some other info to stop a DCA trying to claim a miserly £8.00 from me ... no enforeceable agreement means no entitlement on their part to collect a 'debt'

thanks Paintball on both counts! It would appear bc have only supplied 6 years worth, account is probably about 10 years old. will write and ask for rest/anything else they hold, but will claim my charges at the same time.

I kind have took my eye off the ball on this one, and wish to pick it back up.
I sent a request for refund on both PPI and FAP in December 2008, but got no response. In the letter I stated that I wanted it cancelled and I did not request this upon application, etc.
Since march 09 to date, they are still charging me.
My original letter quoted the 8 weeks before contacting the Financial Ombudsman to investigate but obviously I didn't follow up (had bigger issues to deal with).
Any advice on how to resurrect this claim what be great!

Wow time flies by!!! Still haven't done this, and I still get get charged "optional" PPI and sometimes Over Limit charges as a result, so would at very least like to claim for those inbetween my original claim in Dec08 and now.
Any advice? Fyi I don't have proof of postage of the original claim which asked for cancellation of PPI, and I moved out of that address shortly after so never saw a response.
