Hi, my first post.

 

I had an accident on Friday 10th.

I have 3rd Party insurance.

It was the other drivers fault.

I need to Know how I go about claiming against his insurance.

 

I contacted my insurance and they said fine, but they will not claim for me.

What do I do?

step by step.

Also what can I claim for?

repairs/bus/taxi travel to get from Scene of accident to destination/removal of vechicle to garage?

You write to the other party stating that you hold them responsible for the accident and ask them to confirm if they wish to deal with the matter privately or if they wish to go through their insurance, if that's the case ask them to send this letter onto their insurers.

 

Their insurers (if they are asked for indemnity) will then write to you asking why you think their policyholder was to blame and for a note of what you are claiming for.

 

So you reply stating how the accident happened and why you hold them responsible.

 

You also make a list of anything you have had to pay out that you wouldn't have had to pay out if the accident hadn't happened, and send that with receipts to them.

Also, did you take out any legal expense cover? Your schedule of insurance will show if you have. This will pay for solicitors to act on your behalf.

 

If not, then dealing with the TP insurer should be similar to dealing with your own.
