Have you sent of a CCA request for this yet and or a SAR for all the statements, I see you say that you have worked out the charges and applied to have them re-paid back, what steps exactly have you done.
also could a mod please merge these threads and move it to the debt collection forum

I have not sent of the CCA as of yet, the SAR has been done and i have complete statemnts from begining to current (we are slowly paying of the balance).
I have then worked out the 8% interest (as shown on Martin Lewis website), and have sent of 2 letters to Marbles so far, we have had one responce with them saying that they dont except the OFT report and that they will not refund anything, I responded with a lba, and gave them 14 more days to reconsider.
the current step that i am at is preparing the court papers (as i figure it will be required to go that far).
So that is where i am at, i was looking for some POC to put in the court papers

I can find the POCs for a variety of credit cards, do i just use one of them and edit it with Marbles details.

I have had the second responce from Marbles stating that the OFT is pants and that they dont except it......
....however they will refund £180 as a goodwill gesture (about half the charges and none of the interest). obviously i am going to take that as much as i will sprout wings and fly there.
But is the next step straight to court or is it best to reply with will take as part payment but you have 14 days to give the balance?

Well letter is prepared and bar the signing from my good lady wife it will soon be gone.

Actually just thought of something else, when i looked through the paperwork that we had, my wife was also served a Default Notice a couple of years ago (during a bad financial patch), would i ask that this be removed seperately (as we owed them around £1,080 at the most, and they owe us around £359 in charges), or in the context of demanding the money back?

HFC Banks policy regarding OFT charges is that the first time you write to them they will reject you. The second time they will offer you half, and the third time they will offer a full refund.
Great so i sent them on friday a No thank you, give me back the money in full or we go to court. It would be nice to not have to go to court as it saves time and money.
Btw will they pay the interest as well or just the charges? (as interest would be nice but i can live with just the £300 odd back thieving oiks

Hello Van As defaults are notoriously difficult to remove in isolation, in the past I have succeeded in having them removed by including them with a request for return of credit card charges (specifically with Barclays and Natwest). You should include a statement requesting the removal of the default notice and all adverse marker data from the credit record in your correspondence ...
