    Default Should she accept vouchers?

    Hi,

    my girlfriends sister who has just started her third year of university, has just accepted from PC world vouchers for her broken laptop.

    Now this initially broke because she sent it in for repair with the ac lead, which by the way you should never do because you'll inevitably lose it.
    Anyway, they sent it back with a different lead which eventually destroyed the battery. Since that time the laptop has been in for repairs a number of times and the last time i told her to mention SOGAicon and the 'not fit for purpose' clause. Now this laptop is over a year old, they initially over the phone stated they would give her a full refund, they then reneged on this agreement, divided the purchase price by 6 yearsicon, and deducted 1 years worth off of the price. They then told her that the refund would only be in vouchers and only can be used in PC World, or Currys.

    Surely this cannot be right, to have to accept vouchers, i can sort of understand the reduced refund because of use etc.., but to have to accept vouchers for a place that messed her about is taking the proverbial ****, if you ask me.

    I'm now in the process of trying to find a suitable laptop for her at these stores, but when i check them against online prices, you can purchase better models for the same price. Sometimes the better models cost a couple of hundred pounds more, but have been reduced.

    So back to the point, has she got the right to refuse these vouchers and demand cash or check?

    Quick answer yes

    The SOGAicon not fit for purpose has nothing to do with it as the machine clealy was fit for purpose as you/girlfriends sister has had it for over a year, if the machine was not fit for purpose ie could not do what they claimed it could then you would have returned it asap and you could of got a full refund. If your going to start quoting SoGA to people read it and understand it first.

    Now if the machine goes wrong in the manufactures warranty then it is there responsibility replace it and in this case their agent (pcw) to replace it and thats what they have offered to do, they also only have to offer you make and spec equivalent to what yours is so there is no chance of getting vouchers for the full value. If the person on the phone told you were going to get a full refund they were simply wrong and as the call centre and pcw are run by two different companies you would be hard pressed to make them honor what the agent said and like i said before they only have to offer you one of the spec.

    Also i hate to say this becuase i hate pcw and i would personally never buy a pcw or laptop from there but at the end of the day they sell all the big brands there (sony, hp, dell, acer, toshiba, fujitsu, compaq) so if you got cash your only going to go buy one of these brands so save yourself the hassel and the time and just except the vouchers threating court and actually going through with it will take months and as i am someone that has just finish uni i know how vital it is to have your own laptop in the final year.

    Erm, I think SOGAicon has EVERYTHING to do with this. if it conks out after just a year then it is not of durable quality - s.14.

    PCW are correct technically in reducing the refund - that is covered by part 5A of SoGA.

    They cannot hoever force vouchers on you. You are entitled to have it as cash.

    Good luck to your daughter in her final year!

    Well, unless I am mistaken, the 1st post says she already has accepted the vouchers in which case no, she can't go back and demand money instead. :-?

    Well you could argue that they breached the consumer protection (restrictions on statements) order which prohibits statements that interfere with statutory rights. Claiming tat she could only have vouchers is an interferenc with rights and I personally, if I wanted the cash, would complain and erport it to consumer direct. they are out of order (PCW - not CD!)

    At what point did i say that SoGA had nothing to do with this? I said the bit about fit for purpose had nothing to do with this and it doesn't. As i am sure we are all aware SoGA act has something to do with everything we buy but his time to claim it was not fit for purpose is long gone.

    My advice is still take the vouchers for the same reasons i said before, it take you months to argue this one out with pc world will millions of letters going to their slack customer services department and stupidly long phone callsicon that are all costing you money and hassel. If you did pursue your case you would probably get a cheque from the customer service department but do not expect to walk into a stoor and for them to hand over some case becuase i will not happen
