    Default is this wise ????

    i am new to all this and i have read faq , but if i missed something please forgive me !!!!
    complicated question , here goes.....
    we have
    1 current account with woolwich, 1 open plan joint account with woolwich, one mortgageicon in husbands name only with mortgageicon deeds also his name only

    we are now separated but because open plan account is in arrears and we have overdrafticon on current account they will not take my name off till all is paid up, husband went to court for repossion on mortgage in feb, and was told he could keep house so long as he kept payments up for 12 months etc... current account is not in arrears at the moment..... all husbands finances go through payplan....
    i am now single parent on benefits who could really do with my money being given back !! i estimate at least 3k in charges over 6 yearsicon as husband a financial nightmare... i would like to claim it back and am willing to fight all the way, as i am on benefits in a council house i really do have nothing to lose,
    BUT>>> if i put in a claim for joint current account would my actions risk husband losing the mortgage or the open plan account ? since they are both in arrears and he has almost been repossessed? the current account could be shut no probs but can they close all accounts out of retaliation ?

    hope i made some sense and didnt stress mods by posting a load of stuff already answered...i am angrey because all the stress financially cost us our marriageicon and i would like to have something for the kids, please help thanks xxx

    If you make a claim on the joint current a/c, this should not affect other a/c if you are not claiming on those. The mortgageicon is covered by a separate agreement and wouldn't be affected.
    Would the est. £3000 pay off the overdrafticon?
    If you don't have the statements you need to send the DPA request letter (in bank templates libraryicon) + £10 fee to find out exactly how much you could claim and take it from there.
    Do you use this a/c, if so it would be a good idea to open a parachuteicon a/c with another bank before you start.

    many thanks, i would only claim for the current account and husband will be opening a safe account incase, yes if 3k was awarded we could pay off overdrafticon £300 and close account anyway, i just wanted reassurance they couldnt get nasty and threaten to close the accounts im not claiming for, xx
