    Default Whits vs Barclaycard/Mercers

    Hi guys,
following a succesful fight against Barclaysicon last year, I've come to the conclusion that I enjoyed the fight and need the money.

I'm getting the usual letters from Mercers demanding payment and a ridiculous amount of calls from them, even at work despite never having given them that number.

I sent off the harrasment letter last week and received a reply from Barclaycard saying that they are upset that I'm unhappy

And they promise to sort it out by Oct 23rd. However, in the same post, I also received another letter from Mercers with the usual threats followed a few minutes later by another call from them.

I don't even bother having my house phone plugged in unless I'm making a call.

Whilst the calls and theats don't bother me and whilst I fully acknowledge that I am in arrears, I'm not taking their rubbish.

So what do I do now? Do I send off for the CCA, if so, how do I go about this? Or do I go straight to reclaiming unfair charges?

    Many thanks, Whits

Hi Whits and welcome to the BC forum.

Use Letter N from here and send to Mercers with the £1 fee - http://www.consumeractiongroup.co.uk...templates.html

Copy the letter to BC for their information and tell BC, if they continue to harass you with demands and phone callsicon, you'll report them and Marcers to Trading Standards, the fosicon and OFCOM, for breach of the OFT Guidelines on debt collectionicon.

If you don't have statements for the a/c, you can consider sending them an S.A.R - (Subject access requesticon). Wait to see if a Credit Agreement comes back first.

    Hello Whits!

    Good advice from Slick132.

Only comment I would add is to send the CCA Request straight to the Top:

    The Company Secretary
    Barclaysicon Bank plc
    1 Churchill Place
    London
    E14 5HP

The reason is Mercers are Barclaycard, and Barclaycard are just Barclays Bank plc Trading As.

If you check my last Post on the Thread below, you may see why it is vital to send all key Documents to the correct primary address:

    mackerel vs barclaycard!

Barclaycard like to use the Mercers angle to pretend things are serious by using the nasty words debt collectoricon. But, as many have pointed out, the Mercers Staff and Barclaycard Staff are usually one and the same people, or at the very least, are sitting in the same Office.

Both are part of Barclays Bank plc, so I'd advise that you cut out the Monkey and send it straight to the Organ Grinder.

    Cheers,
    BRW

Thank you both for your replies, very helpful indeed. Unlike Mercers who continue to phone.

I shall definitely be sending off for the CCA as soon as I get paid and then take it from there.

As for sending everything to the organ grinder, I will be doing that.

    Thanks again.
