Hello,
thank you very much for this opportunity given to us.
i bought a ticket from hatfield to st neots with a young person's discount card which i later found out that it has expired abt 4days ago i did not realised as i hadnt used it for a while i was questioned by a FCC officer who want to believe i want to deliberately get away with it. The fcc officer took my details and said i will get a fine of 35pds and that they will write to me. he took my ticket and my discount photo card from me as evidence, i was trying to explain to him but he will not litsen.
Abt three weeks later i got a letter from thier prosecution office asking me to explain what happend i did thinking they will write it off or give me a fine for abt 35pds as the fcc officer said but they saent me another letter asking me to report to court and that am being prosecuted. this is really embarrasing to me the fact is i paid 6.60 at the ticket office not from the machine. i was served by fcc sales representative who i showed my discount card to, i beleive the sale rep has a duty of checking my discount card if its valid or not before issueing me with the ticket but nothing of that sort was done he just gave me the ticket. i really did not realised the card has expired, this is a genuine mistake that can happend to anybody as the sales rep even did not see that it has expired. i dont know what to do. its not fair that i should be punish this way as am not the only one at fault here. i will like to know what my option are plz?
thank you very much
It is your responsibility to check you are travelling with the correct ticket and correct proof of discount.
The sales clerk does not have a responsibility to check your entitlement to discount. They do have a responsibility to sell you what you ask for, when you ask for it.
I would suggest you write to FCC fraud asking to plead guilty out of court, you will be charged an admin fee and their costs. That way you will not get a criminal record.
They have evidence of your out of date railcard.
