Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
About 4 weeks ago OH received a bizarre letter from the Fraud department of Barclaycard. The author implied that a telephone conversation had taken place between himself and OH. The account number was not that of either of OH's accounts which are in dispute due to no compliant CCAs
It went on to say, that the enclosed form should be signed in order for Barclaycard to track down the Witness statement (?) that OH thought he had sent in and to identify the person to whom OH had reported the fraud.
A letter was sent back, unsigned, to say that it was believed that the letter had been incorrectly sent as the account number was unknown and no fraud had been reported or witness statement supplied.
A further letter from the same author 10 days later, it was written with an air of panic. "You must telephone the author of this letter ASAP in order for your claim to be investigated". This time there was one number different from the original letter, still bearing no resemblance to either of OH's accounts.
Just to be absolutely sure, I went through information supplied by B/Card by way of the S.A.R.... and there it was, it would appear that an internal accounting number had been used instead of either of the card account numbers.
So this in fact was a complete fiction on the part of B/Card in order to have OH telephone to discover what this "Fraud" was all about?
A complaint to their head office produced a response from their Director's office, which is far from satisfactory.
Apparently there was some confusion and all further letters from the Fraud Department are to be ignored. The author of this letter has totally ignored the fact that a blatant untruth was made in that a telephone conversation had been had with OH.
I am wondering now if in the light of B/Card being fined a huge sum of money for their Silent telephone calls, which they said were due to them trying to advise their customers of potential fraud (some story that one) they are now resorting to letters of this type to get people to phone ?
When the Liberals and Conservatives were in opposition, they both agreed that banks should pay back high bank charges to customers. Nothing seems to have happened since they came into power as a coalition. PPI Insurance has been sorted. Now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

There does not seem to be any low this lot will not stoop to in order to try and scare the living daylights out of people who are having real financial trouble
