    Default Advice please with a Credit Card

    Ok lets talk hyperthetical. Clued up Consumer had a credit card with a random credit card company (lets call them Have your eyes out credit card) which she was struggling to pay. She then found CAGicon (yay!) and got clued up. She sent Have your eyes out a CCA request several months ago, to which they sent her back a bad photocopy of a microphisched application. Now Clued up Consumer wrote back, and said that this wasn't acceptable, but didn't put in the letter why. Have your eyes out wrote back and said that this was all she was entitled to under the Consumer Credit Act. Clued up Consumer wrote back and said "Nope, the necessary terms and conditionsicon were not there, and anyway it was an application form." Nothing more is heard from Have your eyes out.

    Fast forward a couple of months and Clued up Consumer gets a letter from a DCAicon (lets call them Daylight Robbery DCA) which may, or may not be an in-house DCA. There is nothing in their letter to say that they are connected to Have your eyes out Credit Card, but Clued up Consumer has done some homework, and has a sneaky suspiscion that they are in-house.

    Basically the letter from Daylight Robbery DCA says "pay up or its off to the poorhouse with you!" Clued up Consumer send the "Bemused because the account is in disputeicon with Have your eyes out Credit Card and has been since the 12+2 working days elapsed" letter. So far Clued up Consumer has had nothing back from Daylight Robbery DCA in response to this.

    Clued up consumer has had no notice of assignment from Have your eyes out, and they have passed on the account despite it being in dispute. What action can Clued up Consumer take now against Have your eyes out credit card, and Daylight Robbery DCA?

Yes they are still sleeping until Clued up keeps hounding them ,they may react with litigation which clued up knows very well they cant instigate litigation no CCA no enforcable debt but have they not got anything better than an Application agreement thats the gamble!!!keep prodding the bear and they might just go out of their way to find somthing more enforcable
