Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I read the FAQs for days and had several sleepless nights before launching my attack on Royal Bank of Scotland. I have made Subject access request on my personal account using the template in the library and delivered it by hand. I then got brave and decided to begin the same process for my business account. I had all the statements and info I needed and so proceeded straight to the letter before action (the business account one) requesting my money back. Have I missed something, or is it really that simple. I didn't enclose a schedule of charges because the template didn't suggest I have to. Although I feel righteous and positive, I am also terrified and half wish I had never started. Please help me...:-?
With what? You seem to be doing fine. Have you had any credit card charges levied in the last 6 years? Any credit agreements, anything like that? If so, sue them too.
No credit card charges.. my claim relates to an unstable period in my life which is long since over... Just paranoid, though and terrified I'll bump into a bank official in town or something.. Am I right in thinking that the Bank have only 14 days to respond to my lba?
hahaha... don't worry about bumping into an official in the street... what can they do?
14 day deadline for lba is correct but you shouldn't really try to find a shortcut. The step by step instructions are there because they work. I would suggest waiting the 14 days then sending another LBA. Schedule of charges isn't really necessary at this point but how did you know how much you were claiming?
Oh yeah, you should also start a new thread in the bank specific forum as well please. You will get more much support and advice in there. This bit is really just to introduce yourself.
Just the FAQ’s ma'am. Please read 'em thoroughly before jumping in. Cheers

Are you saying you never sent the prelim letter ? the court expects you to try and settle this before starting a claim. They think 28 days is a resonable time hence the time we give them in our letters. If you have not sent the prelim but have jumped straight to the lba , as your post suggests, then after the 14 days I would send them a further letter saying you are prepared to give them another 14 days as a good will gesture .
This is only my opinion so others may give you different advice as usually we say once the 14 days are up after LBA immediatly start a claim.

I didn't send a prelim letter because the library template only had one business version.. also I took it in by hand. Should I send other communication recorded delivery? Please help me!
hiya
when did you take the letter in to the branch ? Have you had any response ?
when the 14 days is up I would follow mjanets suggestion and send a new lba giving another 14 days 'as a goodwill gesture' - send this one by first class (or recorded for your own peace of mind) to the banks head office. You can enclose a schedule of charges with this too.

Thank you for that advice.. In spite of the fact that I seem to have been reading cases for days and hours on end, I am still very new to this lark and learning to navigate the site. I had read that the letter for business claims was different and went straight to it in the library templates.. is there a business version of the prelim letter please? Anyway, hopefully I won't have done too much damage..
Having just read this article (which I can't scan in, sadly) I feel deflated and worried that all us guys on THE MISSION will come to a sticky end.. Am I just being pessimistic, or are we all too late:-?
