    Default Egg county court

    Sent my S.A.R approx 3wks ago. During this time the DCAicon have put in a claim at nottingham county courticon for £4300 (outstanding card balance). i advised the DCA that they can not do this as the amount owed is in dispute due to charges on the account in the region of £2500 not inc. interesticon. I am now responding to the court papers by stating that the amount is in dispute due to unlawful charges put on the account. Does anyone know that if i do this, will they still put a CCJ on my credit rating. Thank you in advance.

    could you possibly up load details surrounding this, including correspondence remove personally identifiable information first IMHO it will assist people to give advice in relation to your circumstances.

    Experian et al would have no hesitation recording any CCJ verdict from county courticon. The question is will the county court judge find in favour of the creditor.

    The allegedly unlawful bank charges you dispute, have you lodged a Small Claim and had your hearing stayed by court pending appeal of the Test Case? Such a stay would certainly count more than any commercial correspondence indicating your intent to reclaim. Are all ongoing creditor actions towards obtaining CCJ necessarily stalled by the 2-year wait for the Test Case? I doubt it.

    Suggest you click SEARCH in the top blue bar, click Advanced Search, input search keyword CCJ as "Search in thread title only". The threads returnded will give you reading material.
