Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Having found these forums I took it upon myself to look at a loan that I took out with RBS in Oct 2006 I was unaware that they had put PPI on the loan which totals about £1600,00 and to top it all off the actual PPI states that I must be in employment..
I haven't been working for the past 11 YEARS!!!!!!
I have sent in a letter to request the full amount of PPI payments back plus interest as per advice on this forum (I used the template letter too very helpful) I was wondering has anyone else had a successful PPI claim with RBS???
I am willing to take this all the way though as they have surely mis-sold me this policy as I cannot and never have been able to claim on it!
I did have quick question for anyone that knows, I have already paid 22 months on the PPI do they refund that and deduct the rest of the loan or will they deduct the whole lot off the loan if I am successful with this?
Anyway I will keep people updated on how it goes, crossing everything possible as we could seriously do with this refunded/deducted from the loan at the moment

I have not had much luck with RBS so I currently have 3 complaints lodged with the fos 1 with the Information Commissioners Office, OFT, FSA and BBA. This is my link if you take time to read through you may possibly find posts that will help you.

when you are successful you can ask for the money to be refunded by cheque.

Thanks for the reply, its funny you pointed me to that thread as I was just going through it as I checked this one
I cannot see how RBS have a leg to stand on really they sold me a policy that clearly states I need to be employed to claim and I was on income support as a single parent at the time it was taken out!
Shall see what happens when I get a response from them, I will take this all the way though as its a awful lot of cash to pay out for something that is totally useless to me
I certainly will ask for advice, I will wait for a response from the letter I sent a few days ago and go from there, I don't expect they will roll over right away to be honest as they are gonna try and wriggle their way out of it no doubt.

Hello Lucy,
It will be extremely interest to see what they come up with regarding the fact they applied PPI to cover you for being off work, when you have not worked for 11yrs
This is a blatant case of mis-selling and should be reported to the financial services authority immediately. If the FSA get enough complaints, they will take action against them.
Maybe we need to send them a complaint for all those on this site that they have used and abused, causing financial misery, escalating debt to thousands for their targets and profits and then refused to sort it out, giving us all the big round around and stress.

Thanks guys for all your advice, I will wait to see what I hear back from RBS about the PPI and then go from there...
I was wondering if I miss a payment etc on the loan does it affect my PPI claim at all? Reason I ask if I am probably going to have to miss a couple of months payments until we can back on track with money, basically house etc comes before them and I don't want that to effect any claim I have with them at all..
I was wondering if I miss a payment etc on the loan does it affect my PPI claim at all?
No, either the PPI was mis-sold or it wasn't - whether or not you've missed any payments is completely irrelevant.
NatWest: seeking unlawful charges + interest incurred as a result of those charges of £4,292.82 and contractual interest (compounded) of £4,559.41. Court claim issued 16.01.08; acknowledgement of service filled by Cobbetts on 30.01.08
I recieved a response from RBS 3 days ago which basically said they are taking my complaint about the PPI very seriously, enclosed was a form for me to fill out which was basically a few question about my emplyment situation at the time of the loan etc, filled it all in and sent it back..
I recieved a response from RBS 3 days ago which basically said they are taking my complaint about the PPI very seriously, (This was due to an internal memo I believe they do not want to face a comprehensive fine from the FSA as Alliance and Leicester has just had a £7m fine imposed the biggest so far for mis-selling PPI) enclosed was a form for me to fill out which was basically a few question about my emplyment situation at the time of the loan etc, filled it all in and sent it back..
So I await their next reply with anticipation
Please see this from post 287 on my thread.
Quote:
One bank, RBS/Natwest, has responded to the fos's approach to the FSA by changing its attitude to dealing with customer complaints about PPI. According to an internal bank memo, dated 22 August, the bank decided "at Group Senior Executive level to reduce the volume of complaints going to FOS" to demonstrate to the FSA and FOS that their concerns have been taken on board
the link...
See even through the fog of a celebratory glass of wine I can do it:grin:
the sunglasses will be for tomorrow then:grin:
aa
This was due to my first win through the FOS after refusing their goodwill offer of £2,600 they have now made an offer of Over £3,800 Through the FOS Adjudicator.
Check out an earlier post in your thread and it has the link. One down Two to go
Keep at the them and good luck if you can use anything in my thread to help your case just copy and paste and put in your own specific details to
make your case.

I recived a letter from them last week, basically said they found they where in the right and I was in the wrong.. ehhh NO!
Anyway at the end of the letter it basically says, we will however be offering a goodwill gesture due to you being a valued customer and will be intouch shortly with this offer, RBS accept no liability when making this offer blah blah blah!
I will wait and see what they offer and then decide if I want to take it further, if its not much under I may just take it as to be honest I cannot wait months and months for this to get sorted out! All depends on how much they decide to offer me..
Will let you all know when I recieve a reply with my offer!

Keep at them bigtime and make sure you prevail
RBS Have done the same with my claim through the fos ! and the answer is they do not want a massive fine from the FSA so they will offer to settle as a goodwill gesture and without any admission of liability.
I have accepted 1 offer on these grounds after I refused £2.6k and the inclusion of the Financial Ombudsman Service got that increased to £3.8k
Still have two complaints with the FOS to be resolved

I wish you good fortune with your claim time is of the utmost importance But The CAG have to prevail.
I have just noticed something very odd regarding my loan, I can see it online through my online banking and I just nipped in there to check my current account..
Anyway two payments have gone through on my loan just yesterday amounting to just over £500 I only noticed this because the loan is near as damn it 5000, and the balance was 4500..
Does anyone know because I have made a claim have they credited my account because the PPI would of obviously been cancelled?
I am rather confused as I have still not recieved this so called goodwill gesture offer so I would think I can assume it has nothing at all to do with that because I have neither accepted or rejected this as of yet!

I would wait to see what their goodwill gesture without admission of liability is. Then make your decision. I held out and got approx another 30% in a revised offer.
However only one person can make the decision on what to do.
The RBS are doing this, keeping everyone waiting holding them off for as long as possible and then making goodwill gestures at the last minute to keep the FSA at bay.
