Had an apointment on the phone with CCCA today.
Never really got any help from them only to say that i needed to cut back on my expences. As i'm on benefits and on incapacity benefit, i seem it hard to find where i can cut back on.
I was also advised to sell my house to pay for my credit card dept which is approx £18.000 at the moment.
I did mention that i have asked for a Credit Card Agreement from the companies, and was fobbed of saying why ask for that as they would send me a original CCA.
I was also told that i probably go to Court and they would get an order to get there money back through the house.
Can anybody give me a bit of advice on this matter.
Doesn't sound like good advice they've offered you what so ever, but for CCCA it does sound like them, must be a script "Advise to cut back on spending..."
You say you have made a request for your agreement under the CCA, has the company responded yet?
It is true though, a creditor can apply for a charging order on a property, but only if the court allows it.

No none of the companies have responded to my thread, except i had a letter from Mercers (Barclaycard) in house and a letter from Abbey demanding money (in there dreams).
Also i forgot to say i'm a full time carer who needs a motor that has been addapted for my father. The CCCA told me that i dont need the vehical and to sell it to cut costs. If it was for me finding this forum a few weeks back i don't no where i would of stood with them.
So long as you sent your request for a copy of the original credit agreement correctly, paying the £1.00 fee along with the letter requesting it, the company has 14 days to respond (12 days + 2 for post) to respond, if after this time the company fails to supply then they'll default, and it should give you some breathing space and time to get things together and sorted out.
Is the vehicle supplied by motor mobility? - If so then the only cost is fuel, as everything else would be paid. (VEL/Insurance)
Mercers/BC aren't very clever at responding, usually send an application form that does not meet most of the prescribed terms (as in the case of my mum at least.) If I remember correctly Abbey uses MBNA for issuing of Credit Cards, and MBNA aren't that good either at supplying the CCA.
When did you request these, and have any of them contacted you since asking for money?

No, the car i brought and got adapted for my dad.
The 12 + 2 working days is up this friday the 25th.
Yes, Mercers did send one of there side kicks around to the house to collect money but they was turned away.
Just to update you on this thread, MBNA/Abbey replied to my CCA request. Which is a very bad copy of my agreement.
I've got a link on this site for my MBNA/Abbey Account.
I'm still paying them £1 token payments, which they have not refused at the moment.
Are you able to scan and upload the copy of the agreement blanking out all personal details including barcodes, numbers and reference numbers then myself and others can view and comment on it.
Continue to pay the £1.00 token payments, they'll not refuse them MBNA never do, and then once the agreement is looked at to check if it is enforceable to decide your next course of action regarding repayment.
