Hello, im talking on behalf of a friend, she is behind with council tax and goodwillie and corcoran took it over, but she defaulted on the payments as she couldnt afford it, now the bailiffs are threatening her, she has not seen them, or signed anything, but has had a ltr put through her door, so she called him, he wants £550 by Wed!!!

POINT OUT to your friend that private bailiffs are not officers of the court and they have very little power.

 

Please tell her also that if the bailiffs appear on her doorstep SHE MUST NOT LET THEM IN. They have no right of entry unless they have previously been let in.

 

Also, she MUST NOT SIGN ANYTHING.

 

Find out how much council tax is owed, plus the court fee, and then work out whether the bailiffs are trying to overcharge her.

 

In her case, as they have never visited her home but only sent a letter, they cannot add on ANY charges. If they visit the property, the legal charges are: £24.50 the first time they come, and £18 for a second visit. They can't charge for more than two visits, provided they are not allowed in and nothing has been signed.

 

She should also ask the council to take back the debt, thereby cutting out the bailifs altogether.
