01J Parked in a restricted street during prescribed hours
I was on a motorcycle and i parked on a yellow line during loading hours on two seperate days to collect takeaway.
£200 for the same offence is something i cannot afford to pay so i was wondering if i could argue the fact i was only picking up an order i had placed
I have jus read this quote
“No person shall cause or permit any vehicle to wait during the prescribed hours in any
restricted street except.......for so long as may be necessary for delivering or collecting goods or
loading or unloading the vehicle at premises adjacent to the street”
And both days i was parked there i was collecting goods (pizza meal deal) for myself and another person.
The first day i even had the carrier bag containg both pizza meals on the handle of my motor cycle because i had forgotten my bag, whilst on the 2nd day i had a backpack
I suspect collecting pizzas would be classed as "shopping" and not loading as per the parking exception. Shopping and loading are recognised as seperate functions when it comes to parking restrictions and would not therefore allow you to park where not allowed.
g&m he was on a motorcycle.......not exactly classed as loading is it. Message to OP, pay up
You could legally load a motorcycle if it had a top box or panniers for example but the vehicle must be used for the carriage of the goods not a person carrying goods. (there has been adjudication on this)
Not a fan of Council PCNs because of the maladministration I keep seeing but - be fair mate - yeah you could have ridden a bicycle there - why didn't you? One pcn, legitimatley issued as far as i can see and then you do it again the next day?
If you check a few other threads you will possibly see that I quite like the idea of overturning PCNs issued in dubious circumstances or through non-compliant, illegal paperwork.
In your situation i also have to be honest. As I said, i agree with 'Chester', pay it, you have no case AFAICS.
Maybe something in the name now though? How did it get addressed to your mum. How exactly addressed? Initial as well?

OK, out of my depth on that one but I still think it may have some value.
I'll probably get shot for this but i really don't care. I recommend you seek advice on that via the 'PePiPoo' forum. google 'fightback forums' and it comes up top of the list. there is a far better base of knowledge there and they will probably know the relevance.
be prepared, they will want the full story and to see the PCNs.
