Help needed regarding companies who deal with getting back bank charges
Hi,
I have a problem with a company who i gave permission to deal with my bank recovery charges, so im hoping someone who has knowledge of these companies can help with my situation.
I went with a company called financial claimsuk.com last year in july, and at the moment they are supposed to be dealing with 2 of my accounts one being a credit card company Barclays.
Now i am aware of what is happening with OFT test case and the claims are on hold, but the level of service i am getting from financial claims i am not happy with. They have employed staff from india who when you call do not have any idea of what is going on with my claims and advise me to wait for an email from their claims department for an update as they only have old records on there systems. its been 2 days and all i get is this answer. I am aware you can still claim on credit cards, but i dont think financial claims have done anything at all yet. Im pretty sure from the response i was getting from speaking to a a member of staff they have not requested for my last 6 years bank statements yet either.
I was wondering if it would be possible for me to deal with this myself and not let the company deal with it? i did sign an agreement form but is there any way i can get out of letting the company deal with my claim anymore. I dont trust the company at all anymore and i dont want them to deal with my claim at all,
i would really appreciate it if someone could advise me on what i can do.

All i know is i signed the forms for them to take action to reclaim my bank charges for my accounts that i gave them and they take 10% of whatever they get for me.
Would i be able to cancel the agreement without getting a copy of the agreement?
I will contact them tommorow requesting a copy of my agreement if that is really needed.

Whoever this claim company are, write as follows:-
Dear Sir or Madam,
As you have failed to provide the service you offered with regard to reclaiming bank charges, I hereby cancel my any agreement I have with you with immediate effect.
I also hereby withdraw any authority which I gave you to act on my behalf in connection with my personal financial affairs.
Please delete all information concerning me which you have on record.
I have no wish to communicate with you further. Please put in writing anything you have to say - I will not talk to you by telephone.

...........If the company have a problem with the letter above, no doubt they'll write to you, and you can deal with the matter then.
There's no excuse for them not dealing with the credit card claim, which is not affected by the OFT test case. That's why I have no hesitation in recommending that you simply cancel the "agreement" with them.
Reclaiming your credit card charges should be straightforward. Please confirm if it is Barclaycard, so we can move this thread to the right forum for you.
Read the Reclaiming Charges Guide in Link No1 in my signature below.
If you don't have your statements, send BC an SAR.
If you have the statements, prepare the necessary Schedule of Charges using a Site Spreadsheet.
Start a new thread in the appropriate forum for the other a/c you want to claim on.

I will be sending the letter of today and hopefully they will accept this. Thanks for all the help iv received from members on here. I dont have all my statements so im going to make letters requesting these to all my banks first.
Ok right i am going to claim on 4 accounts and one of them is a Barclays. so i am going to start new threads for the other accounts. should i keep the barclays in here?
Iv looked on the site and cannot find anything to do with Capital One, where should i start the thread relating to that?

Ill discuss my Barclays on this thread. Currently iv missed payments for my barclays i owe them like £32 and iv had letters and phone calls this has been going on for about 2 months now. Since about 2 weeks ago they have said if i dont pay soon they will contact an outside agency (door step collection service) and collect the money i owe. I have spoken to them saying i will pay on a certain date but i dont work and dont have any income apart from my student loan which i havent received yet and i am currently a student and cant pay them i dont have any money at all. I feel they will in the next week or so have someone visit my home. Can you advise me on what i can do?

Ok ill do that tell him to bog off lol. Its a Barclays credit card that i have. I feel relieved now knowing they cant do anything. Thanks for the help guys.

Junior don't hope that company will accept the letter - I bet they don't respond - timewasters.
Read lots of longer threads so you will know what to expect from Barclaycard. Take a deep breath and smile - this is going to be fun and financially rewarding. Any questions just ask - I sometimes think slick has a camp bed next to the computer!!!!!

Ok, but firstly i need to get my statements first before i can send that letter of, i have used a template letter asking for my statements, and will be sending this off today along with a postal order for £10 and 2 forms of i.d (copy of passport and birth certificate). Hopefully should get a response within 40 days. Ill keep you all updated. Thanks for the help.

Ok i was at the early stages of reclaiming my bank charges, i requested the bank statements from Barclays and im happy to say i have received those in the post today. Im just a bit concerned and confused about the letter they sent me with my statements i have included the sections below which sound a little odd to me.
"Statments held prior to May 2004 are stored on microfilm which is a means of storage that does not fall within the definition of 'relevant filling system' under the data protection act 1998 ("the act") not within the bounds of what we are obliged to provide in response to your data subject access rewuest as set out on the informations commissioners office website at Information Commissioner's Office - ICO.
The information commisioner has indicated his intention to amend this guidance. It is therefore as a gesture of goodwill to you. out customer, and in the light of this proposed change that we enclose copies of our pre May 2004 statements as you requested although we take a different view to the information commissioners office on whether these fall within the definition of "relevant filing system" as set out in the act.
Can anybody analyse this and see whether or not this would affect my claim?
Ok i have been looking at my statements going far back as sept 2002 and within my statements it actually shows the intrest i was charged and the estimated intrest for the next month. So can i get back my intrest? if i can which ones do i add up the estimated or the intrest i was actually charged?
I have also been charged late payment and over the limit charges also do i add these to my claim also? some charges in 2003 show that i was charged £15 for a late payment but i dont think it was that back then.
All help will be appreciated on this, thanks in advance.
