On the 8th June I sent two recorded DPAR letters via recorded delivery, one to Natwests registered address in London and one to Halifax's registered address in Yorkshire.
Royal Mails tracking service failed to find the 13 digit reference number that I correctly entered. I phoned Royal Mail and they confirmed that there was no delivery confirmation for either of the two letters and told me that I had to wait to the 27th June before they would consider the letters lost.
It seems strange to me that two letters destined for two very different regions of the country should go "missing". Do you think the two banks may have refused to accept the letter?
So at this point I do not know if the letters have been delivered, and I don't know if the 40 days inwhich they have to comply with my request has already started.
I do not want to wait until the 27th, especially if I am going to be told "they are missing".
Should I wait the 40 days just incase they have been received at Natwest & The Halifax? or should I hand deliver two new letters to my local branches of the said two banks and ask for a signature to say that they had received them?

I wouldn't worry too much about the RM track and trace. None of mine ever showed up as delivered but from the letters I got back from them they were.
Normal 1st class post is deemed delivered 2 days later (from what I have learnt on this site).
40 days starts from their receipt of payment (£10), I'm pretty sure. Read around - there are posts relating directly to this issue..

Nemo me impune lacessit! The hours of folly are measured by the clock; but of wisdom, no clock can measure. As long as one person lives in darkness, then it seems to be a responsibility to tell other people.
Well, if your letter is deemed delivered 2 days after sending, that means your cheque was too. Their 40 days begins upon receipt of the request and payment.
What I would do is send them a second letter reminding them that you sent your request and payment on <date> and that their 40 days expires on <date> and they therefore have <x> days to comply. Just to kind of "jimmy them along" a bit.
I find it extremely unlikely that they would select your letter out of the thousands received that morning and refuse to sign for it. What I think far more likely is that the postman (as usual) hasn't returned his delivery card to the Post Office and therefore the proof of delivery is lost.
Stonelaughter and 5Laws are spot on, if you read pixlmixer, kerrylampard and my threads, we have all had this problem. Pixl didnt see any receipt of letters on track and trace but cheque has been cashed. I sent 3 letters, none were signed for but have assumed them received from 2 days after posting 1st class recorded.
Its a common problem at the moment, must be due to high volume of DPA letters being sent!
Start the 40 day clock ticking and follow up with reminder letter if nowt happens.

I was just wondering if someone could confirm whether all the "charges" listed below are eligable to be included within the charges I am claiming a refund for.
I thought it was time I started my own thread. Here I will update you with progress as I attempt to reclaim my money back from those ********, otherwise known as Natwest.
A Subject access request including a cheque for £10 was sent via recorded delivery on the 8th June.
Royal Mail were unable to supply me with proof of delivery therefore I could not be sure the SAR - (Subject access request) - (Subject Access Request) - (Subject Access Request) - (Subject Access Request) - (Subject Access Request) - (Subject Access Request) had been received at Natwests registered address in London.
However the 6 years worth of statements arrived via Special Delivery on the 8th July.
The statements were securly contained within a strong plastic envelope.
I have checked through all the statements and arrived at a total of £2,203.00!
(much more than I expected)
I have today posted a Request for Refund letter via Special Delivery to Natwests registered address in London.
I will keep you updated if and when they respond. ;-)
*Do not use Recorded Delivery, use Special Delivery, that way you are guarenteed a signature and therefore you will know for sure the letter has been delivered!*

Hi, yes i did the same thing by sending my Data Protection off to Natwest but to the local branch and i assume that this will be forwarded onto the relevant department, I addressed it to the Data Protection Officer and requested all information they hold on me and mentioned bank statements i also included photocopy I.D to verify who i am. I won't be doing it via recorded again although it has been delivered i have to pay £2.20 on Royal Mail to get the signiture.!!!!
I was wondering if anyone could answer my query.
This relates to my normal weekly/monthly statements that I receive on a normal basis. (not SAR statements)
Why do Natwest bank statements take so long to arrive. By the time they arrive they are so out of date they are of very little use in trying to operate your account within bounderies.
Is it a deliberate ploy by the bank?
Does anyone "on the inside" have the answer?

Good lick Yaesu, great to see there are even more people in the background filing their claims using the all the correct methods. My claim was acknowledged on 08/08/08, so i'm a little bit ahead of you at the moment.
Well my claim was duely acccepted by MCOL and papers served on Natwest.
Natwest have acknowledged my claim and indicated that they plan to file a defence.
The case continues.......
