    Default PCN issued on child drop off

    Hi all

    I received a pcnicon this morning whilst dropping off my 18 month old baby at the child minder. I have a permit for the area but there were no spaces and I thought I was allowed 3 minutes double parking, so stuck hazards on and parked adjacent to parked cars and alongside a builder truck who was also double parked but loading up truck. Within 2 minutes on return to car a warden was issuing a ticket. I didn't engage other than to say i had only been 2 minutes and jumped in the car to drive off. As i did so he lunged at the screen to stick his ticket on (car not moving yet but ignition turned on and I was belted into driver seat) and continued typing into his handset as i drove off.

    As stated I thought I was allowed 3 minutes for drop off. Any advice as to how to present this defence or a better one given the facts would be appreciated. A scan of the PCN can be found here:

    I have had to contest a wrongly issued ticket before which I won but unfortunately as the car is on a personal lease I still had to pay as car hire co charge £25 adminicon fee for passing on NTO to me. So if there is a way of not getting to this stage it would be even better.

    as long as the SEA is tickety-boo this one may be tough. They need to have applied under Schedule 10 paragraph 3 (1) – (4) asking the Secretary of State to designate the relevant part of their area as an SEA. But London is an SPA anyway. I don't know if there is a get out with the TMA problem in this area. The regulations for Dropped footways and double parking contain an oversight as the TMA does not include the exemption previously allowed for enforcement without signage. They have left in place the legislation but this could be challenged. Try writing to the DfT re approved sign for enforcement of double parking, mention the TMA oversight. A bit more research reveal a possible chink in the armour: "The TMA enables authorities with CPE power to enforce in a Special Enforcement Area (SEA) prohibitions of double parking and parking at dropped footways as if they had been introduced using a Traffic Regulations Order (Traffic Management Order in London). Any Special Parking Area that existed before commencement of the TMA 2004 automatically becomes an SEA and the restrictions need to be indicated with traffic signs or road markings. Authorities should make sure that the public are aware of the new restrictions before starting enforcement. "
