Hi, i have signed yes but they are getting the car into a garage to be checked as i was not happy with a noise coming from the wheel. I have paid half the deposit and am due to see them tomorrow to pay the remainder. So can i still cancel??
tell them this
you will be returning the car at your first oppertunity on the phone,
they will say you cant cancell
just tell them the points raised on my link
record it if you can and send a fax as confirmation at first oppertunity
believe me, they are sharks and the sales man will not want to loose his commission

As of yet i dont have the car, they still have it there as there was something i was not happy with (noise from the wheels) so i have not physically taken the car from them.
Read it and i am definitely faxing them in the morning, i will also be recording the phone call as i can on my mobile. So in the letter i fax i just say i "name and address" wish to invoke S57 CCA 1974 as the car is not yet in my possession and still on your premises then i need not return it. And sign and date?
As promised here is the update. Firstly i had to ring welcome asking for their fax number. The guy i spoke to really did not want to give me these details, so asked questions such as postcode, name etc and why i was ringing. I said i needed the fax number to fax across my paper part license for them as i did not have it the day before. After this he supplied me with the number, i faxed across my statement wishing to cancel the agreement and that i had witnesses and proof they had received it. Then i rang them to tell them as well, recording the conversation. I was given the usual crap that nobody else would finance me for a car and that was the reason for such a high rate. I explained to him that i had found incorrect information on my credit report which i will be challenging, he tried all the tricks in the book to say that i would not get finance elsewhere. So i said i was recording the conversation and wished to cancel. He said that i could as the agreement had not been executed, and i said i want the deposit put back onto the credit card i paid with, again he said that would be done when the finance people were in. I did receive a further call from the salesman that sold me the car asking if there was a problem And i said that it was a ridiculous price to pay for a car that was four years old without any warranty and that i had heard they are shisters to deal with. He said well if things don't work out then i can get in touch and they can help me out. I am now going to check that they have refunded my deposit. And a BIG thank you to postggi for saving me a lot of problems and a huge amount of debt. Particularly as i was given a months notice as work has slowed down. So i would have been worse off as i refused their PPI as well, not that it would have been worth anything anyway.
I have definitely tipped your scales as you saved me a lot of trouble. They really did not want to give me their fax number at first, even though they did not know my intentions. These people are just loan sharks disguised as bad salesmen. What makes it even worse is that there people in there that were obviously in financial difficulty and were signing any paperwork that was out under their noses. I would honestly rather walk everywhere until i clear the incorrect information on my credit report.
Well suprise suprise, welcome finance have not refunded the deposit back to my credit card. Like i said, i did record the conversation with them saying they would do this. If the monies are not returned by tomorrow morning what would be my next course of action??
