Please help, i part exchanged my car for another (used 52 plate) car from a garage. 3 weeks of having this car, the automatic gearbox went.
The spoke to the local garage i bought my car from and they said no warranty applies due to the age and the mileage (100K) of the vehicle and wouldnt take any responsibility however after some negotiation, agreed to repairing it but have asked me to contribute towards it £500. The car is currently being repaired however i feel that i should not need to pay anything towards it.
What should i do next, would really appreciate all the help i can get. :?
If you are happy for a repair or recon box then they must pay for all of it, no gearbox = not fit for purpose under SOGA therefore they must put it right. If it was me I would reject under soga as not being fit for purpose and write to them rejecting it and why asking for a full refund, giving 7 days to respond. do not phone them anymore just do it writing ( recorded ) and keep all records of anything they may say to you and confirm back via E mail etc.
Is any HP involved as they would help as well as it is their car.

Still waiting on response, decided on repair but want it FOC.
However, i have a slight problem. There are things in the car which i wish to get out of the car. The car was being repaired somewhere other than the garage i bought it from, however now with issuing a letter under SOGA etc.. can i phone the garage i bought the car from to see where exactly the car is and get my things out?
Its been a long time and i have had no result at all. All correspondence that is sent to the garage are ingnored and i've taken it to the stage of a judgement being issued. this was issued a few days ago and i have still not heard anything I want my money!!
Is it worth taking the garage to the final stage?? Issuing a warrant?
