Hello all looks a great site for consumers fighting for their rights.....can you help please......on July 24th 2008 i booked and paid by debit card for a hire car over the phone with Easycar looking specifically for a mondeo to drive for a week,as I was thinking of purchasing a Mondeo no other hire car interested me and their rep blatently agreed we could hire a Mondeo however, on arriving at the hire co the very next day I was informed they didn't hire Mondeos at the price quoted but they did hire a more expensive model for £70 more as part of their fleet and so instead offered me a Vauxhall Vectra I said that was no good to me and did not collect the car also the hire co wanted £650 deposit which I was not informed of over the phone I have contacted Easycar that day and on several other occasions since but they refuse to refund me..could this be a mis-sell or break the terms of my contract with them? any help greatfully received

Are you sure they said the hire car would definitely be a Ford Mondeo? It sounds a little odd, as hire companies as far as I'm aware never guarantee the type of car, only the category of car. Indeed Easycar's own website gives the following details:

Hi thanks for the quick reply......To be totally honest i firmly believe i was promised a Mondeo but cannot swear it as fact....however i definately requested a Mondeo in the telephone conversation and repeatedly confirmed I ONLY want to hire a Mondeo to the rep as no other car was of interest to me and at no point was it stated by the rep "we cannot guarantee that particular vehicle".....so in answer to your question had they offered "Mondeo or similar" I would have declined the hire car as i knew those were the terms it stipulated on their website hence my telephone booking to ensure I got the car I wanted.......and unfortunately I didn't record the conversation but a valuable lesson has been learned in that respect believe me

I think you're going to struggle with this as they will most likely just argue that they provided a similar car and therefore fulfilled their part of the contract. You could try and make a request under the DPA for a recording of the call (if one exists) and depending on what was actually said, take things further from there.
It is also good practice for future to record all telephone conversations with organisations as a matter of course as it can be very useful if you need to rely on them at a later date.
