Hi I am new to the site but have been reading a lot of stuff and I have to say how informative and reassuring it is to know that no-one is perfect and people do get issues with money through no fault of their own.
I have a big problem with WELCOME FINANCE - more like welcome to the rip off of the century finance.
My husband and i bought a car over 4 years ago. After 15 months we had to move due to financial issues and my husband getting a job abroad. We paid and told them that we wanted to end the agreement. We had sold our house and had commitments to maintain ( ie husband starting job on a certain date ). They TOLD us to Voluntarily Terminate and that is what we did. I am 100% sure I wrote a letter advising of this and then it was arranged that the car would be picked up. I had to fly abroad to be with my husband and my Dad's girlfriend looked after it, itwas insured MOT'd and taxed. The car was picked up and that was that.
Now only last week we receive a letter from Turnbull Rutherford Solicitors saying that we owe Welcome £14280.00 !!!!!!!! Apparently, they 'sold' the debt onto HFO Services (?) and Turnbulls are their solicitors. The said they were going to get a charging order put on the property !! I called these solicitors and protested our innocence. We knew nothing about this and they had been making enquiries as to whether we owned the property that we are 'linked ' to and say that as we are they are going to do this charging order. Anyway I found out about the CCA and have requested a copy of the agreement and a copy of the payments we have made - who would have any doucmentation after this amount of time ??? The solicitor said he would send me a copy of this agreement - and informed me that we had a massive £11k default against our names in 2006 !! How can they do this when the car was given back - I also understand that anything made from the sale of the car should be put against the 'debt' and that we knew nothing (again) about this default until now ???? This was a week ago and I see that if the agreement is not posted in 12 days they are in breach ???
Our situation is that we only bought the house 8 months ago with no equity and that my husband is disabled and cannot work - I have a child and a limited income. Please help !!!
