Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
To anyone who can offer their help and assistance, I have been offered a goodwill gesture and my next step is to sent the letter back deleting the line 'as full & final settlement' and inserting 'as and interim payment' but where I am confused (and if I am honest, nervous) , I am of the understanding that I have to send this back with the 'letter before action' , Is this the right thing to do? or have I misunderstood?
Is this letter too severe? as I do not want to get their backs up and have them withdrawing this 'gesture of goodwill' but then I do not want them to get away with only paying me less than half of what I have paid out over 6 years!
If there is anyone out there that can tell me if I will be doing the right thing from their past experience ??? I am with the Royal Bank of Scotland

You may well have the good will gesture taken away but if you carry on you will get it all back!!! Too severe???? do they write to you in the same tone?? yes i think so!! its not severe its authoritative, shows you know what you're talking about!!! lol good luck!!!
I QUESTION THEREFORE I AM!!
Unfortunately i'm not an expert in any given field legally and my advice and that of the Consumer Action Group and the Bank Action Group is given without prejudice and without liability so please if in any doubt whatsoever seek help from an insured qualified professional. Hi Julie - i am in the same situation myself, having received a gesture of goodwill also. I think the letter before action is to be used if you haven't received any feedback from your Bank. Having received the 'gesture/ joke' i'm personally going to freestyle a letter back declining, but taking some relevant exerts from the library of letters here because having looked through the libraries i can't see a defined response for this situation. I hope you get on ok and that this may have been of some help?
Rgds
