    Default Please help- redundancy!

    Hi

    This is new to me and I have read lots of posts but nothing compares to the situation I am in and I would appreciate some information as where I need to go with this.

    I work for a contract caterer as a catering manager and have worked at my place of work for nearly 4 years. I have been working for the new contractor for 14 months under tupe terms. I was informed on 17th July (day before I was going on annual leave for 2 weeks) that the company was restructuring and I was to be made redundant. I was told a letter would be sent confirming this in writing and inviting me to a meeting to allow me to present my re-structure ideas. My Main points since then are;

    1. I was given just 24 hours to come up with my ideas for the structure as I was out of the country and our meeting was the morning of my 2nd day back at work. They immediately dismissed all my ideas with no valid reasons and thought 24 hours was adequate.

    2. I have been told that the reason why my company are restructuring is due to the client wanting changes to be made, however my client states in a letter of minutes of a meeting between client and company that they have no problem with me or staff and the problem they have is with the standard of food and quality of suppliers etc which is partly out of my control as I have to use our nominated suppliers and I have already taken action with the Chefs over food standards. (I have evidence of this letter if needed to take further as company blame client for my redundancyicon)

    3. I have not been formerly told in writing yet that I am being made redundant only that changes are to be made and the company is restructuring and we are currently consulting?

    4. To cut a long story short I also have evidence that they have also employed my replacement (chef manager). They asked me to go to another unit at 5pm today to look at something and bought my replacement in to look around my unit. I have evidence from email asking me to go to other unit and luckily our site has cameras and I have seen them on them the very same day showing my replacement around!!

    I have been in touch with my union rep who has said that nothing is formal yet and until they confirm in writing that I am being made redundant to just keep going in and contact him again when formalities begin.

    My company does not have a HR department and I think they have taken a flyer with this one and am not holding my breath for a formal letter, however my manager has informed my client that a letter is being sent as they have scheduled a meeting with me on next weds. (nice for me to be the last to know!)

    Any advice or information would be very much appreciated. At the moment I am having everything backed up in writing, logging everything etc to help me with this

    You really need to get some advice from one of the forum members who have expertise in HR, I did note you comment about your replacement, IMHO you personally can't be redundanticon if the post still exists.

    Advice is based on my personal opinion, and what I have learnt from this forum.
    If you need legal advice please consider consulting a lawyer.

    Hi there, it doesn't sound like a redundancyicon situation to me - it looks like they are just replacing you without going through any disciplinary procedure. Unless they can show how they arrived at selecting you for redundancy and prove how your job is no longer going to exist, then your dismissal will be unfair.

    Keep your union rep in the picture and have him attend at all meetings.
