Hi all,first of all to refer to my heading.I've clicked on the buddy link & the postcode search twice,both times the emails have been sent to myself!Anybody in the Northampton area who can help please let me know asap.Many thanks in advance.
My story then is as follows: Data Protection Act letter sent1/5/06.This was not actioned till the last day of the 40 day period & I received the statements on 9/6/06.Request for repayment letter dated 10/6/06 sent 12/6/06.I used part of the template letter inserting the following,
"You are obviously aware of the advice of the Consumer Action Group & their standard letters to banks available for consumers.This letter is part of a template provided by them,however I feel that the customer relationship between us is such that I don’t need the “legalese” to express my concerns & request the refund.
As your records will show(above reference number),I requested the list of transactions & charges relating to my account.I have now received these(not actioned till the last day of the 40 day period I might add.)I calculate that the charges you have taken plus the extra costs incurred from other companies for failed direct debits etc because of your removal from my account of your charges before their payment plus interest is £600 .I would also request the immediate cessation of any further such charges.
I hope you will respond to this letter in a personal manner accepting,unconditionally ,my request in principle & letting me know a date by which I will receive payment & not reply with standard letters & leaflets.Please contact me within 14 days of the above date.However I look forward to your earliest response."
I had no reply by the 26/6/06 so I drafted the lba on the 27/6/06 with the following change added
;"I am very disappointed that you have failed to respond to my letter of 10/06/2006
Sadly my reference to our customer relationship & not needing the “legalese” has meant nothing to you.Inferring to me that,I,as a customer,mean nothing to you."
I didn't get this sent till 4/7/06 & on 30/6/06 I received a letter from them dated 26/6/06 with the usual standard wording.However there was a paragraph as follows,"Although the charges are correct.I have taken your situation into consideration and I am pleased to advise that I have refunded £75.00 to your account on this occasion,as a gesture of goodwill.However,I must stress that any further charges raised correctly on your account in future will stand."
This was signed on behalf of Miss H Monaghan by KS [undecipherable]I have to point out that up to last night 8/7/06 this hadn't happened.
I then received the standard letter dated 6/7/06 denying all responsibility.
As the 14 day period for this letter isn't up till the 18/7/06,do I have to wait till then before starting court action?(in case they change their mind!LOL)

You have written to them (twice) and they have turned you down for a refund. Some have cut to the chase and put in the Moneyclaim in right away, I am not aware of any troubles that have arisen from this.

Although time has ran out for the bank,I haven't yet gone ahead with the money claim as I haven't been able to open another account yet.Our finances are in such a shambles* that the other banks don't want to know.
*I would love to blame the A&L but it's entirely my fault in spending other peoples money(credit cards,catalogues etc) I am considering an IVA,has anyone else had to do this,if so, how did you get on?
