I have been at my job for 9 months now, and today i had a day off sick. My employer told me on the phone I was lying, based on something I had aappently said to someone else(I wasn't lying, i did feel like crap). Last time i was sick was over 3 months ago, but at the time I was told that further sickness would result in disciplinary action.
I know that when I go in tomorrow he is going to try and do me on this.
Whats the law regarding sickness and disciplinaries?
Can I go in with a preprepared letter stating that any attempt to give me a written warning on this is unlawful or something to that grounds?
I have previously had 2 bouts of sickness, one of 3 days and 1 of 2, both genuine.
Also, one of my colleagues has had 6 seperate sick days, and no written warning.
Also, as i am on a Zero hour contract, I dont have to do any days I dont want to? Whats the law regarding Zero hour Contracts.

Hi there, do you know what your employer's sickness absence policy says? i.e. how many absences before investigation? If you have reached the level of absence that invokes disciplinary action under their policy then there isn't anything you can do - apart from appeal against any disciplinary warning they give you.
Also, as you have worked there for under 12 months, you have less rights than other colleagues who have been there over 12 months, and in reality they could dismiss if they wanted to.

Theres no specific policy in the employee handbook as to how many days, plus the other guy has been there the same amount as me, and has had 6 sick periods as opposed to my 3.
OK, there's not much we can do until you find out what their intentions are. However, you should be given the chance to explain your absence at a return to work interview before any disciplinary action is considered. Ask them for a copy of their absence policy and disciplinary policy.
