Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have a debt to Empire Stores (owned by Redcat) for £617.33. Firstly, I am absolutely certain that I never signed a credit agreement and from reading other threads I believe this makes the debt unenforceable - can anyone confirm this?
Secondly, I have just received an 'Urgent Final Demand' before court action from 'Debt Managers Ltd.' but they seem to have changed my name!!! - Apparently I am now called Kirsty, no similarity whatsoever to my real name - how does this affect the situation? Should I tell them they've got it wrong or not?
Hope someone has some knowledge about this sort of thing - any advice?
Re: Catalogue - Empire Stores / Redcat - Am I liable?
A lot of catalogue debts are unenforeceable because the catalogue companies don't ask their customers to sign credit agreements. We wouldn't advise anyone to avoid paying their debts by using this as an excuse but you have a right to challenge them to produce a true copy of the signed agreement. Search the forum for "consumer credit act" and "letter" and you should be able to find a template letter to send off recorded delivery with the statutory fee of £1. They have 12 days to reply and after 30 days they commit a criminal offence. Once the 12 days are up they can't sue you until they produce a copy of the agreement.
Did the letter containing the incorrect name clearly relate to someone else's account?
