    Default can i still claim?

    Hi all, I wrote to my bank back in feb as i believe i was mis-sold PPIicon, basically i took out a loan to consolidate debts and to pay off existing loan. At the time the advisor told me that the policy would transfer to new loan. I didnt question this as she did not tell me i had the option to cancel. Anyways i got a letter back from bank stating that they could not prove what i was or was not told by the advisor but as they had my signatureicon on the agreement that the believed i was informed and did not uphold my complaint.

    After receiving that letter, i did nothing, i presumed that as i had signed i would not be able to claim, i would be grateful if anyone can tell me if i can still claim or is the bank correct?

    Also am i entitled to cancel the ppi if it is outwith the cancellation period?

    Thanks for any advice offered

    hello misstreated welcome to the PPIicon forum.

(this is a big failure on the advised sales issue i.e not given the full details of the insurance policy in informing you that you had a right to cancel within a certian timescale) Anyways i got a letter back from bank stating that they could not prove what i was or was not told by the advisor (If they cannot prove what the advisor said then you should claim for a mis-sold PPI )but as they had my signatureicon on the agreement that the believed i was informed and did not uphold my complaint.(the signature is fine it is the Bank that have to prove with legal evidence that the Insurance was sold within the legal framework and not sold in any other way with duress. Let them sort the problems out and give you the solution.;-)

    firstly can you inform the CAGicon which financial institution/bank you are with?

    Do you have documentation on your loan?

    Can you give details on the PPI added to your loan?

    Hi alanalana, thanks for your response

    The bank in question is HSBCicon, i have a signed copy of the agreement and a signed copy of the PLP along with the t's & c's of the loan and a insurance sales acknowledgement slip.

    The PLP is for £1890.00 which i think was paid upfront by the bank and then added to my loan, i pay an extra £49.14 on the loan per month for the PLP.

    Any advice most welcome, new at this and very unsure where i stand
