Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
First of all i'd like to say hi, i am a newbee here and havn't got the first clue where to start with claims, i have a few which i used a firm which promised to get my money back for me at a charge, only one year down the line i phoned round a few of my banks and old mortgages only to find out that not a letter has been sent so i am hoping you guys can advise as i am now going to go it alone.
First of all i am going to start with the oldest which from what i have read seems a bit touch and go so better get cracking,
In 1998 i took out a endowment policy on a mortgage i had, it was arranged by a guy called richard harris who to be honest made great promises of mortgage being paid off early and large lump sum to spend, also before i knew it i he got me to sign for the top package in life cover and got me to put my short term girlfriend on it too! any way not long after, me and my girlfriend split and i kept things going on my own untill i heard on the news that enowments might not make enough to pay off the mortgage, to that i bailed out in the first instance and got a repayment mortgage, i was given £1200 for my endowment.
So i was wondering do i have any sort of claim going on? i have all the original agreement mortgage details, life cover refs etc?
yes you can get the information quite easily
Have you entered into a contract with this company if so you may need to get out of the agreement, otherwise you could do the hard work and they would claim their fees.

Can you explain how icecreamman can get the information easily?
Via an SAR, as you have done so yourself I assume.
Do you have a system to sort the requests for information?
Yes at present four lever arch files, I not too keen on saving too much on my computer, might crash don't you know.
If so please post to my thread I have been fighting for information for 7 months I would love to hear your advice on how to get information easily
Did you send it to the correct address, some organisations as you know have multiple address, are you sure you sent it at all, I found one letter I meant to send in the bottom of my brief case.

Via an S.A.R - (Subject access request), as you have done so yourself I assume. (why then did you not post this information to his thread?)

( yes all my letters were sent. You will see from my thread that letters were sent to all. I did not leave any letters in a briefcase. I tend to be more methodical than to miss the opportunity to send letters).
Thank you and may I say good luck to you, do I sense that you aren't too keen on BUMPS, now to end of the hijack of the thread, and return to the OP who still awaits replies.
What should be the next course of action, the first I think is the company they mention, are they tied too it it in some way, and if so could they levy fees.
Does anyone have an idea how the OP can end the contract, this company it appears have not done anything.
I advise an S.A.R - (Subject access request), in order to discover as much information on charges, then go from there.

Hi! sorry but i don't think i have been too clear, i cashed in the endowment 6 years ago which if i remember they gave me less than half what it was worth and too my understanding the life, disability, death etc etc insurance was part of this
AGAIN SORRY ABOUT THE HIJACK, sometimes you get this it is after all an an open forum I am sure that you will receive advise soon, even if it may be negative, I've also posted on your other thread.

Have you paid any money up front for this company to reclaim on your behalf. Do you know if you're tied into any contract with them if you want to reclaim everything yourself.
If you encashed an Endow't Policy only 6 years into, I guess, a 20 years+ policy, it would repay very little. You say you got back half of what it was worth - do you mean half of what you paid in?
Reclaiming bank charges is straightforward and the Site has all the templates to help you do this. Have you read the Reclaiming Charges guide in Link No1 in my signature below.

My first para referred to the company that was supposed to be reclaiming on your behalf. Have you already paid them money up front and have you signed a contract or agreement with them.
If you only got back about half what you paid into an endowment encashed after 6 years, this doesn't surprise me. How long was the product term?

Hi Slick132!
I did fill in a contact with them but after around 8 months and no contact and ignored calls i started digging deeper into things and to cut a long story short the have done no work what so ever, there have been no contact with my mortgage firms or banks, so i phoned the acting firm up and they tried to pass the buck and said it will be sorted in 8 weeks i said its no good and dont want to use them no more, they then said we need it in writing which i have done so i am no independent of firms acting for me
the product term was foe 25 years

Hi Slick 132!
Thanks mate! one last thing though, when challenging the endowment is the insurance part a separate issue, ie PPI, or is it a combined claim?
P.s. any good bass fishing marks round your way
As I've said, I don't see that you have a reason to challenge the endowment surender value (if that's what you're meaning). So mis-sold PPI would be an issue on it's own.
Bass fishing - plenty of decent marks if you know where and when to go. Too many gill nets being used earlier in the season though.
Personally, I prefer fishing Broadstairs or Ramsgate at night. The latter is more productive and it's nice fishing into darkness.

Ok, i get what you mean now, prob a silly question but are PPI's a hard issue to sort out? i have sent one letter requesting contract details, i don't no if i will get them though as i only have the application ref left and details of what i requested on application, also i added an old partner to the life policy advised by hambro so does she need to be part of this? the mortgage and endowment was in my name she was just added to the life policy.
I have a couple of friends from dsaa that used to fish ramsgate at night like you said, they got lucky on occasion.
My friend tunny told me today that they have shut the end of the admiralty for good now, sad loss of a good spot i'd say.
