    Default Advice needed please, can i still claim?

    Hello all, In need of advice please.......


    I am confused as to whether or not to submit a claim for unfair bank charges for my account with Abbeyicon (i am aware claims are being put on hold whilst investigation takes place). I made a claim over a year ago dating back six years for excess of £3000. I received £950 back and stupidly left it at that, failing to demand the rest. Since that date I have incurred even more charges £1500 +. It is a joint account and this final year has been a strain as i was in final year at Uni, as such we were basically surviving on one wage (my partners). No excuse but charges have hit us really hard some months, meaning rent/bills paid late etc.

    In a nut shell, can i make a new claim for balance owing on original amount refunded plus charges incurred since? Will the bank hold it against me that i didn't follow up and demand balance when they made the first refund??

    sorry if this sounds confusing, but i would really appreciate some advice as to next steps to take

    ps i have the original letter of refund. it ends ...

    'Please be assured i have carried out a full investigation for you and hope you feel i have offered a consiered and complete response to all of the issues. I will keep your file open for the next 8 weeks and if i don't hear from you wihin that time, i will assume that everything is resolved and will close your file. If you remain dissatisfied though, the leaflet you'll find with this letter explains your rights and how to take your complaint further within Abbey'.

    Does closing the file mean i can no longer pursue these charges??

    I am sure there is no problem in reclaiming newer charges, the balance of the older charges however, might not be recoverable if Abbeyicon can prove you accepted their final offer.

    what steps do i need to take to find out if i can recover balance of old charges? I didn't sign anything to say that i accepted this as final offer, but will my failure to chase it up basically mean i that it was final?

    Sorry a bit confused??

    with regards to newer charges do i just follow steps of reclaiming, shuld i expect this to be put on hold due to investigations taking place?

    I expect you will receive differing opinions on the first question, in my opinion (Its Only My Opinion) if their letter stated it was a final offer, with the cheque cashed then you accepted that offer.
    You should start the claim for the other charges, yes it will be stayed however it will be in the court system, I would imagine there will be a massive back log once the test case is over.
    In addition you could click on the red triangle, this will open a dialogue box in which you could the site team to direct a member with some expertise to your thread.
