I have been offered the full amount of my claoim from Egg, but because my account was sent to debt recovery agents about 3 years ago and I am still paying off debt they are insisting on payong the amount straight to the debt recovery agent, can they do this

Got a DCA breaking OFT guidance. Complain to the OFT about the DCA. Help put an end to these practices-

Egg, like other credit cards, have different ways of unloading an outstanding debt to collection agents, depending on how they view the eventual outcome.
In cases where Egg is not hopeful of collecting on a probable bad debt, they have been known to sell same for a fixed fraction of the outstanding balance to a DCA. In this scenario Egg would have little interest in what the DCA does recover.
All cards have explicit rules on the order in which monthly minimum payments wipe out outstanding debt, e.g. cash advance debit items are paid off before purchases. T&C online will probably cover this, but I am not sure whether penalty charges are paid off before purchases or after. If the rule is the latter and you have an outstanding balance, then it means you have never actually paid off the unlawful charges, i.e. it has always been a paper transaction, unlawfully levied, but never physically collected from you.
Egg put the debits on the account, now Egg insists on removing said debits from the same place. Hard to counter this line of reasoning, and I would think a Small Claims Court would rule the same way. From the way Egg is acting it looks as if they still have some interest in your account, i.e. they have not sold it in total to a third party.
