    Unhappy redundancy

    hi everyone i need some advice ive worked in my job foe 8 years and for the past 3 years been on a salary which i work 30 hours my pay is 1100 a month ive been off sick for the past 5 month with post natal depression ive returned back t work 2 weeks ago ive been called in the office and been told that due to the smoking ban and the credit crunch the buissness is failing and i have to cut my hours to 20 a week at £6 a hour the other girl i work with for 2 years is being cut to 2o hours but can make her time up in the bar i also work with a 73 year old who has been there for 40 years she is not being affected but they have offered me my redundancyicon i feel im being victimised they say they are suffering yet no other redundancy are being offered and in the last 3 month have put 3 members of staff on a salary if i take my redundancy can i go to the et for unfair dismissal

    You can't just be made redundant without all people in similar roles being put into a 'pool' for consideration. Neither can your working hours be reduced without proper negotiation.

    You need to ask your employer for full details of why you are being singled out as a candidate for redundancyicon, and what other measures the company is considering to improve the profitability of the business. If the employer does not handle the redundancy correctly then you may have a case for unfair dismissal - have a look HERE for more information about the correct procedure to be followed in selecting candidates for redundancy.

    Hard to prove, but bearing in mind the reason for your long term absence, a good employment lawyer could frighten the pants off them with a claim for UD on the gounds of sex discrimination, particularly if male employees are being retained but you are being expected to accept a reduction in hours or redundancy.

    It does sound like the business is in trouble though. I would be very wary about accepting a reduction in hours, as ultimately you could be made redundant anyway and then your severance would only be based on the 20 hours a week worked at that time.
