I know someone who left a company in at the beginning of May. He then received what he thought was his wages, commission and holiday pay in the middle of May.
It has now transpired that the company he worked for over paid him and paid wages for the whole of May.
The company is now asking for reimbursement of the overpayment and are threatening legal action.
Yes, he does have to pay it back, however it was their silly mistake so in this situation I would offer them £1.00 a month and send the first payment with my offer.
Then keep paying back at this rate regardless of any threats of court action.
To my mind if they do not return your first payment they have accepted your offer and I feel a court would ultimately see it the same way.
The over payment will never become his and any attempt to keep it would be classed as theft.
I can't agree that £1 per month would be a reasonable amount to offer.
