Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I did have another thread on here but cant find it now grr
My husband has a select account with ltsb which went slightly over its overdraft (£40) making a total of £90 overdrawn....the account now stands at £540.48 overdrawn we agreed to pay £25 a month to clear the overdraft which hasnt even touched it as they are adding over £100 of charges every month. I have a letter dated 31st July that states
Enforcement Notice served under section 76(1) of the Consumer Credit Act 1974
The terms of the above Overdraft Agreement include the rights of the Bank, at any time to terminate the Agreement and to demand immediate repayment of the overdrawn amount.
We hereby give you formal notice of our intention to terminate the Agreement on 9th August 2008 and to demand payment of £111.17 plus interest, which is accruing daily.
The amount payable is based on the balance at todays date plus accrued interest and charges. The balance will need to be adjusted to allow for further debits or credits to the account. In the meantime your right ti withdraw is suspended, you should not write any more cheques, and no other payments out of the account 9standing orders, direct debits etc) will be made.
If you are unabl to make this payment you may be able to avoid further action by telephoning us now on 0845 6006280 to discuss repayment proposals.
If you have difficulty in paying any sum owing under the agreement, or taking any other action required by this notice, you can apply to the court which may make an order allowing you (or any surety) more time.
If you are not sure what to do, you should get help as soon as possible, for example, you should contact a solicitor, your local trading standards department or your nearest citizens advice bureau.

I also have a letter dated 5th august detailing charges that are going to be added to the account that states
Planned Overdraft £342.00
Balance £540.48
so in the matter of a few days they have again added nearly £100 of charges. They are now charging £20 a day for a max of 10 days per billing period so that balance will substancially increase by beginning of Sept.
I really dont know where to start with it especially as all this money owing is their charges!! all advice much appreciated as i have only just found the enforcement notice and obviously they stated that they would be terminating the agreement on the 9th august and its the 11th today
BTW You can always find your own threads in your User Control Panel, Quick Links tab, My Profile
