    Default Equita Bailiffs

    Hi,

    I have recently discovered that my local council have passed by arrears account to Equita bailiffsicon.

    I contacted Equita in July and made an arrangement to pay monthly. The amount owed was around £324 and I made a £58 payment that day (17/7). As I had had no correspondence from them it was agreed that they would sent a letter to me detailing everything.

    I did not ever get this letter so after several attempts finally spoke to someone on 4th August who said that as I 'broke' the agreement they had passed my details to a bailifficon. I explained that they had never written to me but they refused to discuss the matter any further with me telling me that the bailifficon would have everything on his files.

    I contacted the bailiff who bascially had nothing and has told me that I have until Thursday 14th August to pay him £433 or he will collect goods from my home!! I have agreed to pay this as I have never been in this situation and really am quite frightened. I also don't have that kind of money lying around so have had to make arrangements. The bailiff will not allow instalments he wants the full amount.

    My query really is can Equita do this having not written to me or anything? I have sent a complaint to them via e-mail to which I have heard nothing.

    Any responses gratefully recieved.

    YOU say that the amount originally owed was £324 but Equita are trying to extort (my word!) £433 from you. Obviously this has to be challenged in the strongest possible terms. I know from previous experience that bailiffsicon habitually add on illegal charges and hope that beause their victims don't know the law they can get away with it.

    Have you signed a Walking Possession Order? Has anyone from Equita ever gained access to your home? If the answer to both questions is no then they can only legally charge you £24.50 for their first visit to your property and £18 for a second (if such visits have taken place).

    If you originally owed £324 but have already paid £58, that leaves £266. If £24.50 plus £18 is added on that makes the figure £308.50. Demand from Equita that they give you a Breakdownicon, and do it in writing!

    I'm having similar problems with Equita too but posted on the sticky instead of making a new threadicon

    This refusal to speak to people by them seems to be their standard practice!

    Once you do have an agreement in place, they continue to send you threatening letters stating you have not paid, stating that an agreement has never been made despite them sending you a paying-in book and culminating in a really vicious letter threatening to force entry and seizeicon all your goods for sale at auctionicon then if that doesn't raise enough money to cover the debt, they will then recommend that you be imprisoned

    It's high time the bailifficon "service" was abolished as these parasites prey on the poor, weak and vulnerable with no thought of the heartbreak they cause

    It's a job I could never do. I'd rather scrub floors and clean toilets than ever lower myself to what they do. bailiffsicon are the lowest of the low

    I won't even get started on the threatening, thuggish nature of these apes, suffice to say get advice at every stage of your dealings with them, don't take anything they say at face value. You will even pay for the privilege of paying. £2.50 if you pay by credit card, £1 min for a debit card, I forget the rest but there is no free way to pay. Their number is premium rate, and I have never waited less than 9 mins. SAYNOTO0870.com provides non premium alternatives, equitaicon's is 01604 628360. Good luck and have a large drink waiting, you'll need it after a phone callicon with them.
