Hi guys , first off let me start by saying a big HELLO to everyone on the forum.
I've run into a bit of trouble with A&L.
Like a lot of people on this forum I'd imagine I've also been the victim of A&L's Unpaid Item,£5 a day overdraft chrage , the £25 Overdraft charge etc , you get my drift.
To this day they have penalised me around £300 and also took £35 payment protection insurance with out any official written or any other consent for that matter.
I wrote a letter explaining to them , that their charges were unlawful and basically used a template off one of the site's and edited it slightly.
I was then sent a letter explaining that they couldn't do anything , as The OFT Case was still going on and to wait an outcome for that.
This frustrated me , so I moved to another bank.
Here's where the problem started.
I paid a phone company my monthly bill with my credit card , but unfortunately they still debited the amount the following week leaving me £60 overdrawn.
Over the next month or two the amount rose £212 from the £60.
Naturally A&L informed me of this and advised me to pay it all back straight away.
I sent them a letter explaining that as my other charges still weren't settled and the fact that they stole £35 out of my account , that I wouldn't pay them till I got my others resolved.
Also that I would have to take action to clear my name of the other unfair charges that had mounted up as well.
Today I recieved a letter " Notice Of Intention To Proceed With Debt Recovery Action " , which explained that my account was outstanding £443.24 was to be paid with in 7 days or the matter would be passed onto thier Debt Recovery Section which would start legal proceedings and inform credit agencys about the default staus on my account.
I still won't pay as I personally feel I've been nothing but ripped off from the company.
Has anyone ever had a similar experience and how did you deal with it ?
Your claim will more than likely get 'stayed' but at least you'll be in the 'system' when they come to paying out.
Once you start the process, this puts your account into Dispute, A&L should take no further action on the account until the Dispute is fully resolved.
Send A&L this to remind them.......

I am writing to clarify that I am currently in the process of requesting a refund of bank charges unlawfully made to my account.
I note from your latest correspondence that you are proposing to pass my account on to your Debt Recovery Section - I need to make you fully aware that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved.
If you do not stop this action and proceed by making any adverse comments on my credit reference files, I shall be forced to take legal action against you under the Data Protection Act 1998.
