Please I need some help, I have sent the first letter requesting for my PPI refunds back, its almost £10K. I just received a letter from the Barclays Bank stating that after carrying out a full investigation and reviewing their telephone callls during the loan application process that my case is uphold and they will not pay out.
They also said that after looking into the complaint that the details in respect of both the loan and PPI were explained fully and therefore no payments.
Please what I do ............... any help will be appreciated.

Now have I mis read this, I always took it if a complaint is upheld then they will be due to sort this to pay the money out.
But right now at this stage - do not worry if they are denying this, this is normally a standard fob off response the main of us receive the first time round.
If they have not stated "final response", get a further letter in and tell them if they do not uphold and refund you your PPi plus 8% of what a court would award you will take further action.
Did you use a template from this site to help you or was it your own hun ?
Also if you don't mind me asking, when did you take out this loan ?
We can check if it was prior to 2005 if they were under jurisdiction, they may have been covered with GISC but the FSA did not actually come into force until Jan 2005.
Either way you can still fight this.;-)
If you get another fob off letter from these, then its time to go to the fos if these were covered by these then of when you had taken out the loan.
But not to worry there are other ways this can be dealt with.

I assume they mean not uphold your complaint?
Have you sent a Subject access request asking for all the subject data on you and this particular barclays loan or credit card?
If not and you do not have the original paperwork then you can submit a SAR with a statutory fee of £10.00 (a postal order is best and keep the receipt you may be able to claim the £10 back) and request all the data applicable to you as a subject and in particular the loan you are contesting.
They have a statutory 40 days to respond and if you do not get all the data you ask for (and you must ask for every bit of data in whatever format they hold, paper, tape, microfisch, cd, electronic, telephone call recordings or transcripts, etc) You must be specific and ask for terms and conditions, Customer duty of care check list (if the sale was and advised sale, i.e you talked to a sales advisor) Policy documentation, statement of account etc, then you can submit a complaint to the Information Commissioners Office or start Court action. The ICO is very busy so many complaints on PPI but no Court costs. Such is the magnitude of PPI mis-selling.

However this PPI reclaiming is new and still in its early stages but things are coming together and CAG subscribers are real fighters.
I have just received a final and full offer from Barclays for £3238.60 and they pointed out that this additional refund is made with no admission of liability by the insurers or secured Barclay loan.
My question is should I take it as a partial offer and still go back for the remaining £7000 they charged me. I paid Barclays £9,999 in PPI payments, interest excluded.
And if I decide to purse the rest of the money is there a template I can use or what do I do next.

NatWest Claimed £1,639. Accepted £1,344.
Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.
Barclays 1 Claimed £1,260. Won by default. Paid in full
Barclays 2 Claimed £2,378. Won by default. Paid in full
Birmingham Midshires. Claimed £2,122. Accepted £2,075.
Below is the letters I wrote Barclays that they made me an offer, first letter
I purchased the above policy from you on the dated but now believe that I was mis-sold this policy for the following reasonsas your salesperson was very pushy in selling me the policy so that I felt I could not say no and also I was told that I would stand more chance of getting the loan if I took the Payment Protection Insurance
Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.
And second letter
I am writing in response to your letter dated 23rd July 2008, with regards the insurance sold with my loan.Yourreference is xxxxxxxxx
I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.
And then Barclays offered me a Full and final payment of £3200 which i will not accept, if anyone has a template letter i can use to write them
