Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Almost a year ago a company helped itself of over £500 on my Barclaycard without my knowledge or my consent. I never was their client, weeks earlier I had paid some fees to them for my daughter who is not a co-holder of my credit card. I contested the operation straight away and was sent some forms from Barclaycard which I duly filled in and returned. Since then nothing. I have called numerous times and all I am being told is that the matter will be dealt with shortly. Last month I've written to their complaints department and enclosed all relevant documents with my letter, this time they haven't even bothered writing me back! I just don't know what I'm supposed to do next.
Can anyone help me Please? I am being charged excessive interests on top of it, this is outrageous!!!

I have spoken to BC on many occasions about this and last wrote to you on xxth July, but have received no reply.
The transaction for £500 charged by Whatever Co on xxxx date was taken fraudulently, without my knowledge or consent.
I now require that you refund this amount to my account in full, including an adjustment for interest which has been charged since the transaction date.
If you fail to refund the transaction and interest in full within 14 days, I will take county court action to recover my losses.
You have had ample time to rectify this matter and do not appear to have taken my complaint seriously.
Yours faithfully,
NewAriza
Send the letter off to BC by Rec'd Del'y and send a copy to the Co which made the transaction with a covering letter saying:-
I enclose a copy of my letter sent today to BC, the contents of which are self-explanatory.
You should be aware of this as I will also be taking action against your Co for the recovery of funds which you fraudulently charged to my BC account.

Just for your info, your next step will be an LBA or letter before action to BC and the Company giving them a final 14 days before you start court proceedings.
I'll take advice when required, but it may be that you'll name Barclaycard and the Companyas co-defendants if you file at court.
Did you receive a receipt or any paperwork from the payee at the time of the fraudulent transaction.
Was any further service provided to YD in respect of the £500.
Since the fraudulent transaction, has YD paid for and/or received any further service from the Company. If so, how was this paid for.
