Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
i have been hearing about people claiming back some money from things such as loans and hp etc. I have been looking through my papaer work and sorted out a couple of credit agreements but i am unsure whether i have a claim or not.
I have 2 loans, one with alliance and leicester and the other with the AA. they do not have payment protection on them, but does anyone know if there is anything that i can still claim money back on???
yeah course i am....having to pay it back every month...lol
well i am just trying to find out any possible way that i can make a claim and get back any bit of money possible, as my partner has lost his job recently and having children to pay for, we are finding things a bit of a struggle. so every penny that i can get would be great, but i need to find out what, if anything that i can claim for???

The aim here is to claim back mis-sold Payment Protection Insurance. If this was not applied to your loans then it is unlikely you would be able to make a claim. Without more information on your loans I could not make a statement on whether or not you would have a valid claim on any other aspect of your loan and or claim.
I understand this will not help but if you have more informtion please postand someone will pick up and help.
Thanks for the reply. I have missed a couple of payments because of not having the money at the time to pay due to my partner losing his job. I was charged for late payments, so am i able to claim them back?
I also have a car on finance bought through a BMW garage. Does anyone know about car finance and if there is anything i can claim back on this aswell?? Im desperately trying to get back any money that i can as things are getting harder for us to live!!!

I think the word unlikely is a bit of an understatement - IMPOSSIBLE is probably more appropriate

Contrary to a lot of people's beliefs, companies can make a charge for the costs they incur when someone fails to pay their credit instalments. What is debateable is the amount of the charge and whether it is fair and equitable to the relevant breach. This is not necessarily the same as reclaiming bank charges, as there may be a clearly demonstrable cost to the company. Best bet is to find out the amount of the charges and go from there.

I am unsure of the reasons that you think that you may be able to 'claim' money back from your agreements. The companies you mention are, one would assume, pretty professional concerns who are likely to have valid agreements in place. I am not aware of any premise by which money can be claimed back on loans when the going gets tough - otherwise we would all be at it. Sorry if this is not what you want to hear but I think it only fair to give you a bit of a reality check.
It would probably be better to speak to your creditors and explain the situation at present to see if a period of reduced payments may be available. There is also plenty of free advice available from the CAB, National Debtline and of course this forum.
I think this thread should be moved to a more appropriate place because it is clearly not related to PPI which, ironically, may have prevented the problem in the first place if your partner has lost his job (assuming they were in joint names of course).
thanks for the replies. Well ive have been hearing about so many people claiming back charges and interest and things and having 'claims' that i just wanted to know if there was anything that i could 'claim' before i actualy tried to claim anything.
And as with payment protection...i know of someone who had payment protection on their agreement, and it was impossible for them to actually make a claim on it when they needed to. So it makes you think whats the point of paying out all that money for it if its no good to you. But on one of my agreements, i wasnt actually asked if i wanted payment protection so how was i supposed to take it if i wasnt offered it???

I tend to take a more reasonable view of this (hence the name - lol) as I have benefitted from a PPI claim in the past, and also have the product (at my request) covering my mortgage. On all occasions I have, however, entered into contracts with my eyes wide open!!
The bad news stories tend to be the ones that make the headlines however.

Some companies have decided it is more hassle than it is worth to even offer the product anymore - e.g. Nationwide.
