Zosaphine Vs Lloyds TSB ... hmm whats going on here then??
Hi All
well, i decided to start at the very beginning and a couple of months ago, did a S.A.R to Lloyds TSB. The Data Controller was very helpful & telephoned me to explain that as I'd married & moved since the last details on their system, I'd have to go to my local branch to collect the info, and i'd need to show them a proof of ID such as marriage cert.
I have no issues with doing this. Unfortunately having a full time job & small baby, i haven't yet had chance to do this, but am going to collect them tomorrow lunchtime.
I know i had a large amount of charges added onto my current account prior to me closing it, and I also had a Lloyds TSB Creditcard. (Advantage ?)..
The credit card was passed to Scotcall, and i appreciate you guys have one strong opinion of this company and their tactics to collect debt - however, i must say that the gentleman who came to collect each month, was very professional, polite & over a couple of years we (and my family) built up quite a rapport with him.
it is because he was such a pleasant guy that i had no issues dealing with him or the company he works for!
Anyway... i have got the debt down to £1100 having paid £20 - £30 a month each month.. and a couple of months ago he didn't call as usual... the same again last month...
I contacted him yesterday to see if he would be round soon & he said "I'm glad you contacted me... Lloyds contacted Scotcall to say they were withdrawing the account from them, and that i specifically wasn't to contact you to inform you of this. Can i ask, have you complained about them at all, as this is the only situation that I've known a Bank to withdrawn an account from us before..."
I advised him i hadn't complained, and that the only contact I'd had was the S.A.R - (Subject access request) i made, which tied in with the period he stopped coming to collect....
He laughed and said "well, I'm wondering if you you were thinking about putting in a claim for any bank charges, especially as this was your credit card account.. but of course I can't advise you to do any such thing... but there's loads of info on the internet about how to do it!!!"
So there we have it...
Why would Lloyds take the account back from DCA?
Why would they advise him he cannot contact me?
Is it possible for DCA's to collect after 6 years of a default?
Has anyone claimed back past the magical 6 year timescale, using the argument that it could be interpreted as 6 months from the date of discovery & not the date of the charge? I saw a post on here a little while ago saying this should be possible....
I'm going to get down to collect the info sharpish now, as i'm wondering if they have a valid credit agreement etc.... as I'm desperate to find out why this has happened....
Re: Zosaphine Vs Lloyds TSB ... hmm whats going on here then??
Well, having made a special trip intot he City centre (with my baby in tow), i explained to the ladies working at the information desk what i had gone to collect, showed them my marriage cert... they went intot he back office ........... and returned saying they have had nothing for me to collect.
What do i do now? Issue a letter of Non-compliance?

Yes and mention you called at the branch as requested etc.
In actual fact the chances are that, assuming they did send this to the branch, it would have been destroyed if it wasn't collected within a couple of weeks or so
