    Default Help Applying for CCA's

    Hi, am new to these boards, been having a look about this morning, but am getting confused.

    I am looking at requesting a CCA from both barclaycard and Eggicon about my credit cards, to see if they have an eligable agreement as I have read on here.

    I understand I have to send a £1 cheque with these letters (have used template N) but who do I make them payable to? I have not been able to find this anywhere. I got the addresses from the relevant bank forums.

    Any help would be appreciated

    Make the cheque payable to the card Co. Send it to the DCAicon if any are chasing you, if not , send it to the card Co.
    BTW, do not sign the letter in your normal signatureicon and if you are sending a cheque make sure you don't sign it. If you have a joint account, the joint acc holder must sign it. if not, send a PO.

    It has been known that when they receive a signatureicon from you there may be a chance that a scanner comes into use along with a blank agreement.;-)

    aah, that should prove interesting then as all the agreements were taken out in my maiden name and I signed the cheques in my married name.... let's wait and see.

    As it happens, not one cheque has been cashed and the bank that admitted that they don't have the CCA, returned the cheque saying that they were 'happy to waive their normal fee for this service'!

    Do you know if you have the right to calim back all the money you have paid if it is uneforceable or is there a limit that the banks can pay up to?

    No you can't reclaim money back. At best just get the balance wiped out. Or will probably make them take a reduced amount in full & final.

    Oooh, so why are all these companies charging you £xxxx to challenge unenforceable CCA's also saying that they will get back all the payments that you have made and for you to keep the goods if it was HP or the like???!!. How can the take 30% of compensation if there is none or are they looking at alternative ways of making an agreement unenforceable.

    Trying to reclaim money back has been tried and failed. They rely on the Wilson v First summat or other case. She got a loan and used her car as security. The agreement was flawed and so she got her money back and kept her car. These are very few and far between This company also charge 3495 'up front' but say you get it back if the agreement is enforceable. But guess what? the agreement will be unenforceable , and by the time its 'sorted' you have lost your £495.
    Another company has sprung up recently who charge £1000 up front!!. Someone I heard of, sent details to them ( credit card Co & card No that's all) and 2 days later, they rang back and said the cards are unenforceable!! These guys are psychics! how do they know without an agreement?
    They take 30% by way of a loan you take out to repay them, or put it into another card. Sh*****s all of them!
