    Default Re: Lost license!

Hi all, I have a similar problem so any advice would be greatly appreciated. I passed my test in October 2004 and sent my paperwork/provisional along with test pass certificate to the DVLA in exhange for a full license. I thought I had received my license back from the DVLA, but when I went to check last week I could not find it. I called the DVLA and they have told me 4 different stories, the last person I spoke to told me that I had been written to in December 2004 to state I had a £9 fee missing (I had the post office check everything off for me at a additional fee) and as they had not heard from me they cancelled my application! I told them that I had not received any form of communication from them and they advised me to write a letter explaining what had happened along with a D1 form and they will get back to me in 10 working days - I will either be sent out a Provisional license or will get my full license.

I had a car accident last month and also received a letter from the police that I needed to produce my MOT, Insurance and License which I have bar the license and have told them it is with the DVLA.

Can anyone help me on this? Had a similar situation?

Its unusual that you did not need to show this in the last 4 years !!
So the issues are twofold. Its not an offence not to have a licence after you have passed your test, but there are calls for it to be produced in cases such as car hire.If you have passed your test then you will be showing on the DVLA as being legally able to drive. If they have no record of it then you can get a sopy of the paperwork from the test centre that you took your test at-so long as you can giveapproximate dates.
For the producer, then its an offence if you fail to produce documents within the required time.I know that the Police are able to check on the PNC if you are the holder of a full licence or a banned driver-however I dont know how it appears if you have not been issued with a full licence-presumably it will show that you are still holding a provisional. If you cant produce it then they will either procecute or give further time.
More serious is the other things like insurance. The insurance would not be valid if you did not hold a full licence ..this is a condition for all insurance.
They may point this out to you.

I wasn't aware that the PO did a Check'n'Send service for licences, as I thought this was only for Passports, however - assuming that you did, the fee payable would have been to the POST OFFICE, not DVLA, so if they received your application, the PO would have credited them with the fee - so you can challenge them on that.

Yes Raymond the Post Office do CAS for lots of things.
I asked them if they could check my lottery numbers and tell me if I had a winning ticket(before the draw of course).....needless to say they said they was too busy

Martin, you're just an old cynic! Too busy? I would have thought by the time you handed over the ticket and it was checked in the machine, they'd have LOST it!

Me again, thanks for the replies..

The saga continues with the DVLA and I have now sought legal advice on my situation too.

The letter and D1 form I sent last week was returned a few days ago, addressed to MY SISTER with my forms inside!!! Regardless of the fact the form had my full details on and also had a letter with it with all my details on too. !

I called the DVLA and they could not explain how the mix up happened and have told me to send the form back again, with another letter explaining what has happened this time.

Worse thing is, my sis recalls getting a letter though a few years ago addressed to her asking for a missing fee for her license and did not respond as she only holds a provisional license.

Legal advice I have received has been pretty positive, they have advised me to send the documents back to the DVLA and record everything (as I have been doing) and then I will see if they send me back a provisional license or a full, if the provisional comes back It's unlikely i will be charges with driving without a license or insurance as I will be putting in a compensation claim against the DVLA for breach of data protection act for starters.. Only issue I do have is the insurance company are likely to ask for me to cover the cost of the accident and also the personal injury claims the other party have put in which could cost 10's of thousands..

Keep your fingers crossed for me and I will let you know how I get on!!
