    Default Mbna And Link Financial

    Hello All

    I am a new member who joined today,have been reviewing your consumer forums and decided to take the plunge and join in the fun.

    I am in a long running battle with MBNAicon and Link Financial over PPIicon and the validity of their credit agreement.

    When I applied for my credit card I made it very clear that I did not require this cover by telephone and by not ticking the box on the application form, however they went ahead and charged it anyway after many letters and phone callsicon I finally got a letter from MBNA admitting that I had not applied for PPI on my original application, but they could not confirm that I had not applied for it at a later date and refunded my premiums.


    Having looked into this further I found that they were in breach of the CCa1974 by not adhering to my requirements of the application and therefor the Credit agreement in principle is unenforceable. Despite my pointing this out to them and arguing that the credit agreement was null and void they defaulted me anyway despite there clearly being a dispute again a breach of the CCA. subsequently they sold my account on to Link Financial who are a nasty bunch but I have been fighting with on the grounds of their legal right to collect the debt, they now have a CCJ against me the second time first one I got set asideicon, and I will be attempting to get the second one set aside.

    If anyone has any advice for me it would be greatly appreciated.
