Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just received the following paragraph in a letter from MBNA Re: PPI circa 2001
"I understand that you may decide to pursue your complaint, however, I must advise you that as your complaint regarding the sale of PPC RELATES TO A PERIOD OUTSIDE OF TIME-LIMITS FOR REFERRAL TO THE fos, THEY WILL BE UNABLE TO DEAL WITH YOUR COMPLAINT, unless there are exceptional circumstances"
If that is the case, then WHY are MBNA sending out final responses along with an FOS leaflet or, photo copy of and recommending that complainants take the complaints to that service; The FOS?
It would appear that MBNA are using the Financial Ombudsman Service as a get out...very bad
As these are the same people who are telling all and sundry that, as an American company, they are not subject to UK law, I personally wouldn't believe a word they say.
Send it to the fos anyway. What have you got to lose?

I am not an expert in law, finance or any related field, I just read a lot. Any advice is based solely on what I've read so please don't take it as gospel without checking it out yourself.
I prefer not to give advice by PM. If you want me to look at something, send me a link to your thread, and if I can help I'll reply on there.

Bacause MBNA means Minimal Brains No Assistance.

Who are the MBNA to state what the FOS can and cannot do they are fobbing off big time.
Too many financial institutions are assuming the FOS mantle quite incorrectly. Let us Hope the FOS put them in order. They (banks, loan companies. etc) are out of order to make assumptions on the actions of the FOS in order to put off prospective claimants for mis-sold PPI. They are in a lot of cases CLEARLY OUT OF ORDER.
Just me letting off vented anger at the whole issue off PPI delays
