    Default Fair Wear & Tear

    Getting ready to give notice to my private landlord cos we have now been offered a much cheaper (rent!) little house by the local council.

    We are cleaning carpets, curtains, woodwork, etc, tidying garden and so on. We have been here 2 years. There are a few spots, where the paint on the window cills, doors and skirtings has chipped (maybe not quite the right word). Does this count as fair wear and tear? The contract does not state we have to decorate just keep the property clean and tidy.

    Oh and after reading all these threads I will definately be taking photographs before I leave.

    Any enlightment kindly accepted.

    Personally I would use the deposit as the last months rent and offer to pay for any damage in your notice letter. Technically the landlord could take you to court for the last month's rent but unless he's extremely bloody minded or the flat/house was wrecked, I can't see him doing this.
