Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
OH has had loan with cahoot since 2002, PPI taken out.
redundant in Novemebr 2006 so claimed and paid out, then went self-employed (part-time) in Feb 07, advised them at time. Also caring for disabled child.
Dec 07 work dried up so claimed. They are refusing to pay coz work 'temporary or seasonal'. I have argued that this just interupts previous claim so they should pay out or would they rather OH had not tried to help himself?
Won't pay out on grounds of caring responsibilities either even though OH get carers allowance as if he is working a bit he is not 'full time' caring and also if child attends school he is not caring fulltime either (harsh interpretation - government allow OH to earn up to £85 per week and class fulltime as >35 hours per week). Made loss in 07/08 so no income other than Carers which just covers his minimum loan payments.
Any ideas? I don't want a refund of premiums i want them to pay the claim.
I argued that if the government accepted trading accounts as proof of no income then they should, also that if CA considers full time caring as >35 hours then they should to. And guess what.............
They are settling with a payout of £7k!!!!!! We were only after three months worth of payments (around £2k).
Just goes to show that pushing and arguing back work. It's taken me since December but my god does it feel good!!!!! Picture me now leaping around room punching the air......
It doesn't mean that we have any money still but it does mean that I can close the bl**dy account and forget they exist!!!!
