Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My son scrapped his car last October. He sent off the sorn document with all the details and the scrapyard address. The scrap people collected the car from his home address. A few months ago he got a letter saying he had not declared sorn or re-axed the car.
He rang DVLA and explained to someone that he had sent off the sorn doc but they denied recieving it.
Now on the sorn document it does say that you get a reply within 4 weeks and if you do not, it is your responsibility to chase it us. He didnt do this so technically is in the wrong.
The thing is that a few weeks before he got the letter from DVLA he saw the car taxed and on the road so it has obviously been sold by the scrapyard and re taxed. He actually told the person he spoke to this when he rang in reponse to the letter.
Now, weeks later he has recieved another letter with an £80 fine. He has written to explain that he has already spoken to them and informed them that the car was scrapped, sorn declared and has since been retaxed by the new owner but they wont budge.
DVLA always use the "if in four weeks you do not get confirmation in writing blah blah blah" line, and they don't give up. A SORN should always be done on line because you get an email acknowledgement straight away.
If your son sold the vehicle to a scrapyard he should have notified DVLA as a normal sale into the trade. You only declare a vehicle as scrapped if you physically break up the vehicle yourself.
DVLA are very clever. If you send something to them that gets lost in the post, it is your responsibility. If they send something to you and it gets lost in the post, it is your responsibility.
Sorry, I got confused in my earlier post. he had declared sorn before he scrapped the car. Then when he scrapped it he sent the slip away. He didnt bother about chasing up the sorn because the car was scrapped.
