Unhappy Dispute with council over council tax

    Hi There,

Advice needed on argument with local council.

I have always paid my council tax by direct debiticon, however last year the council made a blunder that resulted in me getting some bank charges. After this i decided to cancel the direct debit and started paying over the counter.

If you pay over the counter payment must be made on the 1st of the month but by direct debit you can pay on 7th,14th,21th,or 28th. Paying on the 1st of the month is not always convenient to me. Over the last couple of months i have paid towards the middle of the month and have received threatening letters from the council saying I'm in arrears. Ironically I have been and paid this months payment today but came home from work to a letter demanding full payment of this years council tax!!! stating that im in arrears and if i dont now pay in full they are going to take me to court !!!, How can i be in arrears when people that are paying by direct debit have not even paid yet this month.

How can they get away with offering 4 different payment dates for direct debit customers but only 1 if you don't want to use direct debit !!. Sounds like discrimination to me but i would like to know how they stand legally.

    Many Thanks Damo

    Hi Damo,

I'm not sure where they stand legally but it is obvious why they prefer to have pay'ts by DD and are willing to accept slightly later pay't dates for DD payers.

    Call the Council offices to:-

    1) Confirm they are happy that your monthly pay's are up to date.

    2) Ask if they can accept your monthly pay'ts on a slightly later date than 1st so you have the money in place for your pay't to clear.

I know it's wrong but you may be better going back onto DD and hope they don't screw up again.

Did you get the Council to pay for the resultant bank charges.

Have you had the chgs refunded by the bank.

Even if you miss one payment the council can legally demand all that years tax and you lose the right to pay in installments.

    Great isn't it?

    Hello there

Can you please tell me if you got this issue resolved with the Council as my parents find themselves in the exact situation.

    Thanks
